18 Section 1. Section 1002.371, Florida Statutes, is
19 created to read:
20 1002.371 Governor's School for Science and
21 Technology.--The Governor's School for Science and Technology
22 is established within the Florida K-20 public education system
23 and shall be administratively housed within the Department of
24 Education.
25 (1) The mission of the Governor's School for Science
26 and Technology is to provide advanced educational
27 opportunities in the areas of science, mathematics,
28 engineering, and technology in a residential setting with
29 highly qualified scientists and instructors organized and
30 provided in short periods of intensive specialized real-life
31 learning experiences for highly motivated and talented

1 students in grades 9 through 12.
2 (2) The school shall be located in Brevard County and
3 be situated where a formal partnership between the school and
4 the Kennedy Space Center may readily be established and
5 maintained to provide real-life learning experiences for
6 students. The attendance area for the school is the entire
7 state; however, admission to the school is a privilege
8 reserved for those qualified students who are selected through
9 a statewide application and qualification system and is not a
10 right afforded to the general population of students in this
11 state. Students enrolled in the school must reside on the
12 school's premises and be under the control of the school.
13 (3) The board of trustees created in subsection (5)
14 shall take such actions as are necessary for planning and
15 establishing the Governor's School for Science and Technology
16 as provided in this section. The board shall submit a progress
17 report to the Commissioner of Education, the Governor, the
18 President of the Senate, and the Speaker of the House of
19 Representatives by January 1, 2008, which must include a
20 timeline for future actions to be completed and a summary of
21 the legislative budget request for the 2008-2009 fiscal year.
22 (4) It is the intent of the Legislature that existing
23 facilities be used for the school and that by the 2009-2010
24 school year the school begin offering:
25 (a) Advanced learning opportunities in the areas of
26 mathematics, science, engineering, and technology to qualified
27 students; and
28 (b) Summer programs for elementary, middle, and high
29 school teachers.
30 (5)(a) A board of trustees is created for the
31 Governor's School for Science and Technology which shall

1 consist of seven members. The trustees shall be appointed by
2 the Governor and are subject to confirmation by the Senate.
3 Trustees shall be appointed to 4-year terms, except that the
4 initial terms shall be staggered so that three members are
5 appointed to 4-year terms, two members are appointed to 3-year
6 terms, and two members are appointed to 2-year terms. The
7 Governor may remove any member for cause and shall fill all
8 vacancies that occur.
9 (b) The board of trustees shall elect a chair
10 annually. The trustees are entitled to reimbursement for
11 travel expenses as provided in s. 112.061, the accounts of
12 which shall be paid by the Chief Financial Officer upon
13 itemized vouchers duly approved by the chair.
14 (c) The board of trustees may adopt rules pursuant to
15 ss. 120.536(1) and 120.54 to implement provisions of law
16 relating to operation of the Governor's School for Science and
17 Technology. Such rules shall be submitted to the State Board
18 of Education for approval or disapproval. After a rule is
19 approved by the State Board of Education, the rule shall be
20 filed immediately with the Department of State. The board of
21 trustees shall act at all times in conjunction with the rules
22 of the State Board of Education.
23 (d) The board of trustees is a body corporate and
24 shall have a corporate seal. Unless otherwise provided by law,
25 all actions of the board of trustees shall be consistent with
26 all laws and rules applicable to state agencies. Title to any
27 gift, donation, or bequest received by the board of trustees
28 pursuant to subparagraph (e)11. shall vest in the board of
29 trustees. Title to all other property and other assets of the
30 Governor's School for Science and Technology shall vest in the
31 State Board of Education, but the board of trustees shall have

1 complete jurisdiction over the management of the school.
2 (e) The board of trustees has full power and authority
3 to:
4 1. Appoint or remove a director, faculty, teachers,
5 and other employees according to its best judgment and fix
6 their compensation.
7 2. Procure professional services such as architectural
8 and engineering services.
9 3. Procure legal services without the prior written
10 approval of the Attorney General.
11 4. Determine eligibility of students and procedure for
12 admission, including, but not limited to:
13 a. The requirements that an individual must meet in
14 order to be qualified for admission to the Governor's School
15 for Science and Technology and the standards by which
16 applicants will be selected for admission to the school.
17 Priority must be given to individuals who excel or demonstrate
18 interest in the areas of mathematics, science, engineering, or
19 technology. The requirements and standards may include, but
20 need not be limited to, scores on tests or favorable
21 recommendations from teachers or other school officials.
22 b. The number of students that may be enrolled at the
23 school based on the resources that are available.
24 c. The procedures by which an individual may apply for
25 admission to the school or appeal a decision concerning an
26 application to attend the school.
27 5. Provide necessary housing, food, and transportation
28 for students while attending the school and the cost of
29 transportation from their home to the school and return.
30 6. Provide for the proper keeping of accounts and
31 records and for budgeting of funds.

1 7. Enter into contracts.
2 8. Sue and be sued.
3 9. Secure public liability insurance.
4 10. Do and perform every other matter or thing
5 requisite to the proper management, maintenance, support, and
6 control of the school at the highest efficiency economically
7 possible, taking into consideration the purposes of the
8 school.
9 11. Receive gifts, donations, and bequests of money or
10 property, real or personal, tangible or intangible, from any
11 person, firm, corporation, or other legal entity. However, the
12 board of trustees may not obligate the state to any
13 expenditure or policy that is not specifically authorized by
14 law. If the bill of sale, will, trust indenture, deed, or
15 other legal conveyance specifies terms and conditions
16 concerning the use of such money or property, the board of
17 trustees shall observe such terms and conditions.
18 12. Sell or convey by bill of sale, deed, or other
19 legal instrument any property, real or personal, received as a
20 gift, donation, or bequest, upon such terms and conditions as
21 the board of trustees considers to be in the best interest of
22 the school and its students.
23 13. Invest such moneys in securities enumerated under
24 s. 215.47(1), (2)(c), (3), (4), and (9), and in The Common
25 Fund, an Investment Management Fund exclusively for nonprofit
26 educational institutions.
27 (f) The board of trustees shall:
28 1. Annually prepare and submit a legislative budget
29 request for the Governor's School for Science and Technology.
30 The legislative budget request shall be prepared using the
31 same format, procedures, and timelines required for the

1 submission of the legislative budget of the Department of
2 Education. The legislative budget request shall be submitted
3 to the department for review and approval. Subsequent to the
4 department's approval, the commissioner shall include the
5 Governor's School for Science and Technology in the
6 department's legislative budget request to the State Board of
7 Education, the Governor, and the Legislature. The legislative
8 budget request and the appropriation for the Governor's School
9 for Science and Technology shall be a separate identifiable
10 sum in the public schools budget entity of the Department of
11 Education. The annual appropriation for the school shall be
12 distributed monthly in payments as nearly equal as possible.
13 2. Approve and administer an annual operating budget.
14 3. Require all funds received other than gifts,
15 donations, bequests, funds raised by or belonging to student
16 clubs or student organizations, and funds held for specific
17 students or in accounts for individual students to be
18 deposited in the State Treasury and expended as authorized in
19 the General Appropriations Act.
20 4. Require all purchases to be in accordance with the
21 provisions of chapter 287, except for purchases made with
22 funds received as gifts, donations, or bequests; funds raised
23 by or belonging to student clubs or student organizations; or
24 funds held for specific students or in accounts for individual
25 students.
26 5. Administer and maintain personnel programs for all
27 employees of the board of trustees and the Governor's School
28 for Science and Technology who shall be state employees,
29 including the personnel classification and pay plan
30 established in accordance with ss. 110.205(2)(d) and
31 216.251(2)(a)2. for academic and academic administrative

1 personnel, the provisions of chapter 110, and the provisions
2 of law that grant authority to the Department of Management
3 Services over such programs for state employees.
4 6. Give preference in appointment and retention in
5 positions of employment as provided within s. 295.07(1).
6 7. Ensure that the Governor's School for Science and
7 Technology complies with s. 1013.351 concerning the
8 coordination of planning between the school and local
9 governing bodies.
10 (6) If the Board of Trustees for the Governor's School
11 for Science and Technology determines that a specific
12 requirement of the School Code prohibits the implementation of
13 an innovative instructional practice by the Governor's School
14 for Science and Technology, the school shall provide a report
15 to the Legislature explaining the desired practice and the
16 statute that prohibits its implementation.
17 (7) Funding for instruction, room, board, and
18 transportation of students and for the operation of the
19 Governor's School for Science and Technology shall be as
20 authorized in the General Appropriations Act. Other funding
21 for the Governor's School for Science and Technology may be
22 provided from:
23 (a) Appropriations from the Legislature or a state
24 agency; and
25 (b) Contributions or endowments from private entities.
26 (8) Students who are approved for attendance at the
27 Governor's School for Science and Technology shall continue to
28 be recorded as enrolled and in attendance for the purpose of
29 funding in their home school district for the period of time
30 the student is away attending the Governor's School for
31 Science and Technology.

1 Section 2. Subsection (5) is added to section 1000.04,
2 Florida Statutes, to read:
3 1000.04 Components for the delivery of public
4 education within the Florida K-20 education system.--Florida's
5 K-20 education system provides for the delivery of public
6 education through publicly supported and controlled K-12
7 schools, community colleges, state universities and other
8 postsecondary educational institutions, other educational
9 institutions, and other educational services as provided or
10 authorized by the Constitution and laws of the state.
11 (5) THE GOVERNOR'S SCHOOL FOR SCIENCE AND
12 TECHNOLOGY.--The Governor's School for Science and Technology
13 is a component of the delivery of public education within
14 Florida's K-20 education system.
15 Section 3. Paragraph (a) of subsection (6) of section
16 1002.20, Florida Statutes, is amended to read:
17 1002.20 K-12 student and parent rights.--Parents of
18 public school students must receive accurate and timely
19 information regarding their child's academic progress and must
20 be informed of ways they can help their child to succeed in
21 school. K-12 students and their parents are afforded numerous
22 statutory rights including, but not limited to, the following:
23 (6) EDUCATIONAL CHOICE.--
24 (a) Public school choices.--Parents of public school
25 students may seek whatever public school choice options that
26 are applicable to their students and are available to students
27 in their school districts. These options may include
28 controlled open enrollment, lab schools, charter schools,
29 charter technical career centers, magnet schools, alternative
30 schools, special programs, advanced placement, dual
31 enrollment, International Baccalaureate, International General

1 Certificate of Secondary Education (pre-AICE), Advanced
2 International Certificate of Education, early admissions,
3 credit by examination or demonstration of competency, the New
4 World School of the Arts, the Florida School for the Deaf and
5 the Blind, the Governor's School for Science and Technology,
6 and the Florida Virtual School. These options may also include
7 the public school choice options of the Opportunity
8 Scholarship Program and the McKay Scholarships for Students
9 with Disabilities Program.
10 Section 4. Paragraph (i) of subsection (1) of section
11 1003.02, Florida Statutes, is amended to read:
12 1003.02 District school board operation and control of
13 public K-12 education within the school district.--As provided
14 in part II of chapter 1001, district school boards are
15 constitutionally and statutorily charged with the operation
16 and control of public K-12 education within their school
17 district. The district school boards must establish, organize,
18 and operate their public K-12 schools and educational
19 programs, employees, and facilities. Their responsibilities
20 include staff development, public K-12 school student
21 education including education for exceptional students and
22 students in juvenile justice programs, special programs, adult
23 education programs, and career education programs.
24 Additionally, district school boards must:
25 (1) Provide for the proper accounting for all students
26 of school age, for the attendance and control of students at
27 school, and for proper attention to health, safety, and other
28 matters relating to the welfare of students in the following
29 fields:
30 (i) Parental notification of acceleration
31 mechanisms.--At the beginning of each school year, notify

1 parents of students in or entering high school of the
2 opportunity and benefits of advanced placement, International
3 Baccalaureate, Advanced International Certificate of
4 Education, dual enrollment, the Governor's School for Science
5 and Technology, and Florida Virtual School courses.
6 Section 5. This act shall take effect July 1, 2007.
