  2         An act relating to hospice facility

  3         construction; amending s. 400.6051, F.S.;

  4         providing for review of construction plans by

  5         the Agency for Health Care Administration;

  6         authorizing the agency to charge fees for such

  7         review; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Section 400.6051, Florida Statutes, is

12  amended to read:

13         400.6051  Construction and renovation; requirements.--

14         (1)  The requirements for the construction and the

15  renovation of a hospice residential or inpatient facility or

16  unit must comply with the provisions of chapter 553 which

17  pertain to building construction standards, including

18  plumbing, electrical code, glass, manufactured buildings,

19  accessibility for persons with disabilities, and the state

20  minimum building codes. The Agency for Health Care

21  Administration shall provide technical assistance to the

22  Florida Building Commission in updating the construction

23  standards of the Florida Building Code which govern hospice

24  facilities.

25         (2)  Upon request by the prospective licensee of an

26  inpatient hospice facility, the agency may provide an informal

27  review of a facility prior to construction in order to assist

28  the facility in complying with agency rules and this part.

29         (3)  The agency may charge a fee that is commensurate

30  with the cost of providing consultation under this section and

31  that is not refundable.
