1 A bill to be entitled
2 An act relating to Lifeline telecommunications
3 services; amending s. 364.10, F.S.; requiring
4 each state agency that determines that a person
5 is eligible for Lifeline service to act
6 immediately to ensure that the person is
7 enrolled in the Lifeline service program;
8 requiring that the Public Service Commission
9 adopt rules by a specified date; requiring the
10 Public Service Commission, the Department of
11 Children and Family Services, and the Office of
12 Public Counsel to enter into a memorandum of
13 understanding regarding their respective duties
14 under the Lifeline service program; providing
15 an effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Paragraph (h) of subsection (3) of section
20 364.10, Florida Statutes, is amended to read:
21 364.10 Undue advantage to person or locality
22 prohibited; Lifeline service.--

24 (h)1. By December 31, 2007 2003, each state agency
25 that provides benefits to persons eligible for Lifeline
26 service shall undertake, in cooperation with the Department of
27 Children and Family Services, the Department of Education, the
28 commission, the Office of Public Counsel, and
29 telecommunications companies providing Lifeline services, the
30 development of procedures to promote Lifeline participation.

1 2. If any state agency determines that a person is
2 eligible for Lifeline service, the agency must act immediately
3 to ensure that the person is automatically enrolled in the
4 program with the appropriate eligible telecommunications
5 carrier. The Public Service Commission shall, no later than
6 September 1, 2007, adopt rules creating procedures to
7 automatically enroll eligible customers in Lifeline service.
8 The rules must include an option for an eligible customer to
9 choose not to subscribe to the Lifeline service.
10 3. The commission, the Department of Children and
11 Family Services, and the Office of Public Counsel shall enter
12 into a memorandum of understanding establishing the respective
13 duties of the commission, the department, and the public
14 counsel with respect to the automatic enrollment procedures.
15 Section 2. This act shall take effect July 1, 2007.

18 SENATE SUMMARY
19 Requires each state agency that determines that a person
