1 A bill to be entitled
2 An act relating to Medicare supplement
3 policies; amending s. 627.672, F.S.; redefining
4 the term "Medicare supplement policy" for
5 purposes of part VIII of ch. 627, F.S., to
6 exclude a health insurance policy or other
7 health benefit plan that is offered by one or
8 more employers to employees or former
9 employees; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Subsection (1) of section 627.672, Florida
14 Statutes, is amended to read:
15 627.672 Definitions.--For the purposes of ss.
16 627.671-627.675:
17 (1) A "Medicare supplement policy" is a health
18 insurance policy or other health benefit plan offered by a
19 private entity to individuals who are entitled to have
20 payments for health care costs made under Medicare, Title
21 XVIII of the Social Security Act ("Medicare"), as presently
22 constituted and as may later be amended, which provides
23 reimbursement for expenses incurred for services and items for
24 which payment may be made under Medicare but which expenses
25 are not reimbursable by reason of the applicability of
26 deductibles, coinsurance amounts, or other limitations imposed
27 by Medicare. The term does not include any such policy or plan
28 of one or more employers that have at least 50 employees at
29 issue or labor organizations, or of the trustees of a fund
30 established by one or more employers or labor organizations,
31 or a combination thereof, for employees or former employees,

1 or a combination thereof, or for members or former members, or
2 a combination thereof, of the labor organizations if, upon
3 termination of eligibility, group members age 65 or older are
4 offered continuation of coverage under the group plan or a
5 conversion policy that has the same benefits as a Medicare
6 supplement policy.
7 Section 2. This act shall take effect July 1, 2007.

COMMITTEE SUBSTITUTE FOR

12 The committee substitute excludes from regulation Medicare
Supplement policies or plans serving certain groups, if, upon
13 termination of eligibility, group members age 65 or older are
offered continuation of coverage under the group plan or a
14 conversion policy that has the same benefits as a Medicare
Supplement policy.
