  1                      A bill to be entitled

  2         An act relating to psychotropic medication;

  3         amending s. 641.31, F.S.; requiring a contract

  4         by a health maintenance organization to cover

  5         psychotropic medication when prescribed as

  6         medically necessary by an authorized physician

  7         to treat a subscriber of the health maintenance

  8         organization; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Present subsections (36), (37), (38), (39),

13  and (40) of section 641.31, Florida Statutes, are redesignated

14  as subsections (37), (38), (39), (40), and (41), respectively,

15  and a new subsection (36) is added to that section, to read:

16         641.31  Health maintenance contracts.--

17         (36)  If a contract by a health maintenance

18  organization provides coverage for a psychotropic medication

19  that has been prescribed as medically necessary by a physician

20  who is authorized by the health maintenance organization for a

21  subscriber, the health maintenance organization may not

22  discontinue coverage for that psychotropic medication for that

23  subscriber.

24         Section 2.  This act shall take effect October 1, 2007,

25  and applies to contracts issued or renewed on or after that

26  date.

29                          SENATE SUMMARY

30    Requires a contract by a health maintenance organization
      to cover psychotropic medication when prescribed as
31    medically necessary by an authorized physician to treat a
      subscriber of the health maintenance organization.
