1 A bill to be entitled
2 An act relating to the remediation of health
3 risks for buildings where contraband has been
4 manufactured illegally; creating within the
5 Executive Office of the Governor the Task Force
6 for the Remediation of Illicit Drug Labs;
7 prescribing the membership of the task force;
8 providing for meetings and duties of the task
9 force; requiring public hearings; providing for
10 members of the task force to be reimbursed for
11 per diem and travel expenses; requiring the
12 Office of Drug Control within the Executive
13 Office of the Governor to provide staff
14 support; requiring that the task force file
15 reports and recommendations to the Governor and
16 the Legislature; requiring cooperation by state
17 agencies; providing an effective date.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Task Force for the Remediation of Illicit
22 Drug Labs.--
23 (1)(a) There is created within the Executive Office of
24 the Governor the Task Force for the Remediation of Illicit
25 Drug Labs, a task force as defined in s. 20.03, Florida
26 Statutes. The task force is created for the purpose of
27 recommending strategies and actions for reducing or
28 eliminating health risks from buildings in this state where
29 methamphetamine or other contraband has been manufactured in
30 violation of law.

1 (b) The task force shall consist of the following 13
2 members:
3 1. The director of the Office of Drug Control within
4 the Executive Office of the Governor, who shall serve as
5 chairperson of the task force.
6 2. The executive director of the Department of Law
7 Enforcement or his or her designee.
8 3. The Secretary of Health or his or her designee.
9 4. The Secretary of Environmental Protection or his or
10 her designee.
11 5. The Secretary of Community Affairs or his or her
12 designee.
13 6. A member of the Senate, appointed by the President
14 of the Senate.
15 7. A member of the House of Representatives, appointed
16 by the Speaker of the House of Representatives.
17 8. A state attorney or his or her designee.
18 9. A representative of the Florida League of Cities.
19 10. A representative of the Florida Association of
20 Counties.
21 11. A sheriff or his or her designee.
22 12. A police chief or his or her designee.
23 13. A representative of the Florida Association of
24 Realtors.
25 (c) The Governor shall appoint the task force members
26 described in subparagraphs (b)8.-13. by July 1, 2007. Such
27 appointees must be representative of the geographic regions
28 and ethnic and gender diversity of this state. The first
29 meeting of the task force shall be held by August 1, 2007. All
30 recommendations of the task force shall be by majority vote.
31 Seven members constitute a quorum.

1 (d) The task force shall meet at the call of the
2 chairperson and shall conduct at least three public meetings
3 in the state.
4 (e) Members of the task force shall serve without
5 compensation, but are entitled to reimbursement for per diem
6 and travel expenses in accordance with s. 112.061, Florida
7 Statutes.
8 (f) The Office of Drug Control within the Executive
9 Office of the Governor, the Department of Law Enforcement, the
10 Department of Health, the Department of Community Affairs, and
11 the Department of Environmental Protection shall provide staff
12 support for the task force within existing appropriations.
13 (2) The task force shall study, take testimony, and
14 develop findings and recommendations regarding the remediation
15 of health risks from buildings in this state where
16 methamphetamine or other contraband has been manufactured in
17 violation of law, including, but not limited to:
18 (a) The nature and extent of such remediation; the
19 standards, training, and funding that are relevant to such
20 remediation; and the responsibility for such remediation.
21 (b) Current state or local laws governing remediation,
22 including consideration of revisions to such laws.
23 (c) Current federal laws or laws of other states which
24 are relevant to such remediation, including the effectiveness
25 of those laws in remediating health risks from buildings where
26 contraband has been manufactured.
27 (d) Any other subject that is relevant to reducing or
28 eliminating the health risks from buildings in this state
29 where methamphetamine or other contraband has been
30 manufactured.

1 (3) The task force shall submit a preliminary draft
2 report of its findings and recommendations to the Governor,
3 the President of the Senate, and the Speaker of the House of
4 Representatives at least 90 days before the first day of the
5 2008 Regular Session of the Legislature. The final report
6 shall be filed with the Governor, the President of the Senate,
7 and the Speaker of the House of Representatives at least 30
8 days before the first day of the 2008 Regular Session. In
9 addition to the findings and recommendations included in the
10 final report, the report must include a draft of proposed
11 rules and proposed legislation for any recommendations
12 requiring a change in rules or legislation.
13 (4) Each state agency shall fully cooperate with the
14 task force in the performance of its duties.
15 (5) All meetings of the task force and all business of
16 the task force for which reimbursement may be requested shall
17 be concluded before the final report is filed.
18 Section 2. This act shall take effect upon becoming a
19 law.

22 SENATE SUMMARY
23 Creates the Task Force for Remediation of Illicit Drug
Labs to study and report concerning remediation of health
24 risks from buildings in this state where contraband has
been manufactured illegally. Provides for membership,
25 duties, and abolishment of the task force. Authorizes
reimbursement for per diem and travel expenses of task
26 force members. Provides for support for the task force
from the Office of Drug Control within the Executive
27 Office of the Governor and other state agencies.
