1 A bill to be entitled
2 An act relating to immunizations; amending ss.
3 402.305, 402.313, and 402.3131, F.S.; adding
4 pneumococcal conjugate vaccine to the list of
5 required vaccines for enrollment in a child
6 care facility, a family day care home, or a
7 large family child care home; requiring the
8 Department of Health to establish rules and
9 protocols; requiring facilities and homes to
10 furnish proof of compliance to the department;
11 providing an effective date.

13 WHEREAS, the State of Florida recognizes the importance
14 of pneumococcal conjugate vaccine for children enrolled or
15 enrolling in child care programs, and
16 WHEREAS, the Florida Department of Health, Bureau of
17 Immunization, acknowledges that vaccines, including
18 pneumococcal conjugate vaccine, focus on disease prevention
19 and are the most cost-effective medical intervention, and
20 WHEREAS, the Centers for Disease Control and
21 Prevention, through the Advisory Committee on Immunization
22 Practices, recommends that children be administered
23 age-appropriate four-dose series of pneumococcal conjugate
24 vaccine, and
25 WHEREAS, pneumococcal conjugate vaccine, which is
26 licensed by the United States Food and Drug Administration, is
27 effective in preventing invasive pneumococcal disease, and
28 WHEREAS, a recent study published in the Journal of the
29 American Medical Association reveals that pneumococcal
30 conjugate vaccine, when administered to children, has
31 significantly reduced the number of invasive pneumococcal

1 disease cases and deaths in the adult population, NOW,
2 THEREFORE,

4 Be It Enacted by the Legislature of the State of Florida:

6 Section 1. Paragraphs (b) and (c) of subsection (9) of
7 section 402.305, Florida Statutes, are redesignated as
8 paragraphs (c) and (d), respectively, and a new paragraph (b)
9 is added to that subsection, to read:
10 402.305 Licensing standards; child care facilities.--
11 (9) ADMISSIONS AND RECORDKEEPING.--
12 (b) Beginning July 1, 2007, the age-appropriate series
13 of pneumococcal conjugate vaccine, as recommended by the
14 Advisory Committee on Immunization Practices of the Centers
15 for Disease Control and Prevention, shall be administered to a
16 child younger than 2 years of age who is enrolled or enrolling
17 in a child care facility. The department shall implement rules
18 to add pneumococcal conjugate vaccine to the current list of
19 required vaccines and establish protocols for children younger
20 than 2 years of age to catch up on missed doses. A child care
21 facility must be able to furnish proof to the department of
22 pneumococcal conjugate vaccine compliance for all children
23 receiving care at the facility by December 1, 2007.
24 Section 2. Subsection (14) is added to section
25 402.313, Florida Statutes, to read:
26 402.313 Family day care homes.--
27 (14) Beginning July 1, 2007, the age-appropriate
28 series of pneumococcal conjugate vaccine, as recommended by
29 the Advisory Committee on Immunization Practices of the
30 Centers for Disease Control and Prevention, shall be
31 administered to a child younger than 2 years of age who is

1 enrolled or enrolling in a family day care home. The
2 department shall implement rules to add pneumococcal conjugate
3 vaccine to the current list of required vaccines and establish

6 furnish proof to the department of pneumococcal conjugate
7 vaccine compliance for all children receiving care at the home

11 402.3131 Large family child care homes.--

14 Advisory Committee on Immunization Practices of the Centers
15 for Disease Control and Prevention, shall be administered to a
16 child younger than 2 years of age who is enrolled or enrolling
17 in a large family child care home. The department shall
18 implement rules to add pneumococcal conjugate vaccine to the
19 current list of required vaccines and establish protocols for
20 children younger than 2 years of age to catch up on missed
21 doses. A large family child care home must be able to furnish
22 proof to the department of pneumococcal conjugate vaccine
23 compliance for all children receiving care at the home by
24 December 1, 2007.
25 Section 4. This act shall take effect July 1, 2007.
