  1                      A bill to be entitled

  2         An act relating to physical education; amending

  3         s. 1001.11, F.S.; requiring the Commissioner of

  4         Education to provide professional development

  5         in physical education; amending s. 1003.01,

  6         F.S.; defining the term "physical education";

  7         amending s. 1003.455, F.S.; requiring specified

  8         periods of physical education for certain

  9         students; requiring the State Board of

10         Education to review and revise the Sunshine

11         State Standards regarding physical education;

12         requiring public schools to have an automated

13         external defibrillator on school grounds;

14         encouraging public and private partnerships to

15         furnish the defibrillators; providing an

16         effective date.

18  Be It Enacted by the Legislature of the State of Florida:

19  

20         Section 1.  Subsection (7) is added to section 1001.11,

21  Florida Statutes, to read:

22         1001.11  Commissioner of Education; other duties.--

23         (7)  The commissioner shall dedicate financial and

24  departmental staff resources to provide professional

25  development for physical education teachers, elementary and

26  secondary teachers whose assignments include physical

27  education courses, and developers of physical education

28  curricula. Such professional development shall incorporate

29  current physical education and nutrition philosophy and best

30  practices that result in student participation in physical

 1  activities that promote lifelong physical and mental

 2  well-being.

 3         Section 2.  Subsection (16) is added to section

 4  1003.01, Florida Statutes, to read:

 5         1003.01  Definitions.--As used in this chapter, the

 6  term:

 7         (16)  "Physical education" means the development or

 8  maintenance of skills related to strength, agility,

 9  flexibility, movement, and stamina, including dance; the

10  development of knowledge and skills regarding teamwork and

11  fair play; the development of knowledge and skills regarding

12  nutrition and physical fitness as part of a healthy lifestyle;

13  and the development of positive attitudes regarding sound

14  nutrition and physical activity as a component of personal

15  well-being.

16         Section 3.  Subsection (3) of section 1003.455, Florida

17  Statutes, is amended to read:

18         1003.455  Physical education; assessment.--

19         (3)  Each district school board shall provide 150

20  minutes of physical education each week for students in

21  kindergarten through grade 5. Students enrolled in such

22  instruction shall be reported through the periodic student

23  membership surveys, and records of such enrollment shall be

24  audited pursuant to s. 1010.305. Each district school board is

25  encouraged to provide 150 minutes of physical education each

26  week for students in kindergarten through grade 5 and 225

27  minutes of physical education each week for students in grades

28  6 through 8.

29         Section 4.  During the 2007-2008 school year, the State

30  Board of Education shall review and revise the Sunshine State

31  Standards related to physical education skills to reflect

 1  state-of-the-art philosophy and practice. The revised

 2  standards shall emphasize the role of physical education in

 3  promoting the knowledge, skills, and attitudes that prepare

 4  students to make healthy lifelong nutrition and physical

 5  fitness choices.

 6         Section 5.  Each public school shall have at least one

 7  operational automated defibrillator on the school grounds.

 8  Schools are encouraged to seek public and private partnerships

 9  to assist with the cost of purchasing, maintenance, and

10  training associated with this section.

11         Section 6.  This act shall take effect upon becoming a

12  law.
