2 An act relating to physical education; amending
3 s. 1001.11, F.S.; requiring the Commissioner of
4 Education to provide professional development
5 in physical education; amending s. 1003.01,
6 F.S.; defining the term "physical education";
7 amending s. 1003.455, F.S.; requiring specified
8 periods of physical education for certain
9 students; authorizing principals to designate
10 instructional personnel to teach physical
11 education; requiring the State Board of
12 Education to review and revise the Sunshine
13 State Standards regarding physical education;
14 requiring public schools to have an automated
15 external defibrillator on school grounds;
16 encouraging public and private partnerships to
17 furnish the defibrillators; providing an
18 effective date.

20 Be It Enacted by the Legislature of the State of Florida:

22 Section 1. Subsection (7) is added to section 1001.11,
23 Florida Statutes, to read:
24 1001.11 Commissioner of Education; other duties.--
25 (7) The commissioner shall dedicate financial and
26 departmental staff resources to provide professional
27 development for physical education teachers, elementary and
28 secondary teachers whose assignments include physical
29 education courses, and developers of physical education
30 curricula. Such professional development shall incorporate
31 current physical education and nutrition philosophy and best

1 practices that result in student participation in physical
2 activities that promote lifelong physical and mental
3 well-being.
4 Section 2. Subsection (16) is added to section
5 1003.01, Florida Statutes, to read:
6 1003.01 Definitions.--As used in this chapter, the
7 term:
8 (16) "Physical education" means the development or
9 maintenance of skills related to strength, agility,
10 flexibility, movement, and stamina, including dance; the
11 development of knowledge and skills regarding teamwork and
12 fair play; the development of knowledge and skills regarding
13 nutrition and physical fitness as part of a healthy lifestyle;
14 and the development of positive attitudes regarding sound
15 nutrition and physical activity as a component of personal
16 well-being.
17 Section 3. Subsection (3) of section 1003.455, Florida
18 Statutes, is amended to read:
19 1003.455 Physical education; assessment.--
20 (3) Each district school board shall provide 150
21 minutes of physical education each week for students in
22 kindergarten through grade 5. Students enrolled in such
23 instruction shall be reported through the periodic student
24 membership surveys, and records of such enrollment shall be
25 audited pursuant to s. 1010.305. Such instruction may be
26 provided by any instructional personnel as defined in s.
27 1012.01, regardless of certification, who are designated by
28 the school principal. Each district school board is encouraged
29 to provide 150 minutes of physical education each week for
30 students in kindergarten through grade 5 and 225 minutes of

1 physical education each week for students in grades 6 through
2 8.
3 Section 4. During the 2007-2008 school year, the State
4 Board of Education shall review and revise the Sunshine State
5 Standards related to physical education skills to reflect
6 state-of-the-art philosophy and practice. The revised
7 standards shall emphasize the role of physical education in
8 promoting the knowledge, skills, and attitudes that prepare
9 students to make healthy lifelong nutrition and physical
10 fitness choices.
11 Section 5. Each public school shall have at least one
12 operational automated external defibrillator on the school
13 grounds. Schools are encouraged to seek public and private
14 partnerships to assist with the cost of purchasing,
15 maintenance, and training associated with this section.
16 Section 6. This act shall take effect upon becoming a
17 law.

22 The committee substitute for committee substitute authorizes a
school principal to designate any instructional personnel,
23 regardless of certification, to teach physical education.
