20         7.06  Broward County.--The boundary lines of Broward
21  County are as follows: Beginning on the east boundary of the
22  State of Florida at a point where the south boundary of
23  township forty-seven south of range forty-three east, produced
24  easterly, would intersect the same; thence westerly on said
25  township boundary to its intersection with the axis or center
26  line of Hillsborough State Drainage Canal, as at present
27  located and constructed; thence westerly along the center line
28  of said canal to its intersection with the range section line
29  dividing ranges forty and sections twenty-six and thirty-five
30  of township forty-seven south, of range forty-one east; thence
31  westerly on the said section line dividing sections

The present corporate limits of the City of 9 Parkland, Broward County, are extended and enlarged to 10 include, in addition to the territory presently within its 11 corporate limits, the area particularly described as follows: 12 (1) That portion of the east one-half of section 13 twenty-nine, township forty-seven south, range forty-one east, 14 Palm Beach County, Florida, lying south and west of the 15 Hillsborough State Drainage Canal; less and except the east 16 eighty-five feet thereof; also less and except the west 17 sixty-five feet thereof; also less and except road 18 right-of-way for State Road No. 827. Also described as that 19 portion of lots two through eight and twenty-five through 20 thirty-two, Florida Fruit Lands Company, section twenty-nine, 21 township forty-seven south, range forty-one east, according to 22 the plat thereof, as recorded in plat book one, page one 23 hundred and two, Public Records Palm Beach County, Florida, 24 lying south and west of the Hillsborough State Drainage Canal; 25 less and except the east eighty-five feet thereof; also less 26 and except the west sixty-five feet thereof; also less and 27 except road right-of-way for State Road No. 827. Said lands situate, lying and being in Palm Beach 24 County, Florida. 25 Section 4. All land use and zoning designations 26 applicable to the lands subject to this act shall continue in 27 effect until changed by the entity or entities with 28 jurisdiction over those lands subsequent to the effective date 29 of this act. Florida Senate - 2007 COMMITTEE AMENDMENT Bill No. SB 2752 Barcode 514400 1 terms, notwithstanding that the lands formerly in Palm Beach 2 County are now part of Broward County. 3 Section 5. All public roads and the public 4 rights-of-way associated therewith, lying within the lands 5 transferred from Palm Beach County to Broward County by this 6 act, are transferred from Palm Beach County's jurisdiction to 7 Broward County except that those public roads and 8 rights-of-way within the lands annexed by the City of Parkland 9 will be transferred to the jurisdiction of that municipality. 10 Section 6. On the effective date of this act, Broward 11 County shall be responsible for and embodied with all powers 12 granted under the State Constitution, the Florida Statutes, 13 and the Broward County Charter over territory transferred to 14 Broward County under s. 7.06, Florida Statutes, as amended by 15 this act. 16 Section 7. On the effective date of this act, the City 17 of Parkland shall be responsible for and embodied with all 18 municipal powers granted in chapter 166, Florida Statutes, and 19 as otherwise provided by law, over territory annexed as 20 described in section 3 of this act. 21 Section 8. Nothing in this act shall be construed to 22 affect or abrogate the rights of parties to any contracts that 23 are in effect prior to the effective date of this act. 24 Section 9. For the purpose of this act, the procedures 25 in chapters 96-542 and 99-447, Laws of Florida, are 26 superseded. 27 Section 10. Palm Beach County and Broward County shall 28 be responsible for the public debt relating to the transferred 29 property as required by Section 1 of Article VII of the State 30 Constitution. If any provision of this act or the 3 application thereof to any person, entity, or circumstance is 4 held invalid, the invalidity does not affect other provisions 5 or applications of the act which can be given effect without 6 the invalid provision or application, and to this end the 7 provisions of this act are severable. 8 Section 12. This act shall take effect upon the latter 9 of the date that the Department of Community Affairs issues a 10 final order finding that the amendment to the map of Palm 11 Beach County's comprehensive plan which was transmitted by 12 Palm Beach County, titled University Drive & Riverside Drive 13 TIM & 2020 Map Amendment (DCA No. 07-01), is in compliance 14 with s. 163.3184, Florida Statutes; the date that the 15 Administration Commission issues a final order finding that 16 such amendment is in compliance with s. 163.3184, Florida 17 Statutes; or the date that the roadway rights-of-way 18 designated in this act are abandoned by Palm Beach County and 19 all appeal periods relating to such abandonment have expired 20 or, if an appeal is filed, a final order confirming the 21 abandonment is issued by a court of competent jurisdiction. 22 For purposes of this section, the Department of Community 23 Affairs' publication of a notice of intent to find such 24 amendment, DCA No. 07-1, to the map of Palm Beach County's 25 comprehensive plan in compliance with s. 163.3184, Florida 26 Statutes, is deemed to be a final order if a petition 27 challenging the amendment is not timely filed. 28 29 30 ================ T I T L E A M E N D M E N T =============== 31 And the title is amended as follows: 8 3:52 PM 04/17/07 s2752d-ca05-s02
