1 A bill to be entitled
2 An act relating to protection and care for
3 elders; amending s. 825.102, F.S.;
4 reclassifying the offense of aggravated abuse
5 of an elderly person or disabled adult from a
6 second-degree felony to a first-degree felony;
7 amending s. 921.0022, F.S., relating to the
8 offense severity ranking chart of the Criminal
9 Punishment Code, to conform; creating s.
10 943.17296, F.S., relating to training on
11 identifying and investigating elder abuse for
12 certified law enforcement officers; requiring
13 that the training be completed by a time
14 certain; providing that an officer's
15 certification becomes inactive in certain
16 circumstances related to the failure to
17 complete the training; providing an effective
18 date.

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. Subsection (2) of section 825.102, Florida
23 Statutes, is amended to read:
24 825.102 Abuse, aggravated abuse, and neglect of an
25 elderly person or disabled adult; penalties.--
26 (2) "Aggravated abuse of an elderly person or disabled
27 adult" occurs when a person:
28 (a) Commits aggravated battery on an elderly person or
29 disabled adult;

1 (b) Willfully tortures, maliciously punishes, or
2 willfully and unlawfully cages, an elderly person or disabled
3 adult; or
4 (c) Knowingly or willfully abuses an elderly person or
5 disabled adult and in so doing causes great bodily harm,
6 permanent disability, or permanent disfigurement to the
7 elderly person or disabled adult.

9 A person who commits aggravated abuse of an elderly person or
10 disabled adult commits a felony of the first second degree,
11 punishable as provided in s. 775.082, s. 775.083, or s.
12 775.084.
13 Section 2. Paragraph (h) of subsection (3) of section
14 921.0022, Florida Statutes, is amended to read:

7 Section 3. Section 943.17296, Florida Statutes, is
8 created to read:
9 943.17296 Training in identification and investigation
10 of elder abuse and neglect.--Each certified law enforcement
11 officer must successfully complete training on identifying and
12 investigating elder abuse and neglect as a part of the basic
13 recruit training of the officer required in s. 943.13(9) or
14 continuing education under s. 943.135(1) before June 30, 2010.
15 The training shall be developed in consultation with the
16 Department of Elderly Affairs and the Department of Children
17 and Family Services and must incorporate instruction on
18 identification of and appropriate responses for persons
19 suffering from dementia and on identifying and investigating
20 elder abuse and neglect. If an officer fails to meet the
21 required training, his or her certification shall become
22 inactive until the employing agency notifies the commission
23 that the officer has completed the training.
24 Section 4. This act shall take effect July 1, 2007.

27 SENATE SUMMARY
28 Reclassifies the offense of aggravated abuse of an
elderly person or disabled adult from a second-degree
29 felony to a first-degree felony. Conforms the offense
severity ranking chart of the Criminal Punishment Code.
30 Requires that the training be completed by a time
certain. Provides that an officer's certification becomes
31 inactive in certain circumstances related to the failure
to complete the training.
