1 A bill to be entitled
2 An act relating to Indian River County;
3 limiting annual increases in the county's
4 operating budget; providing for exemptions to
5 the limitation; providing for a referendum;
6 providing effective dates.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Limitation on increases in Indian River
11 County's operating budget.--Except as provided in this act,
12 annual increases in Indian River County's operating budget may
13 not exceed the percentage increase in the county's population,
14 as determined by the Bureau of Economic and Business
15 Research's latest "Florida Estimates of Population," plus the
16 percentage change in the Consumer Price Index as provided in
17 s. 193.155(1)(b), Florida Statutes. This limitation in annual
18 increases in the county's operating budget may be overcome by
19 a finding of necessity due to emergency or critical need,
20 which finding is approved by a super majority vote of the
21 county commission.
22 Section 2. Referendum.--
23 (1) In conjunction with the next countywide election,
24 and in accordance with the general laws governing elections,
25 the Indian River County Supervisor of Elections shall conduct
26 a referendum of qualified electors of the county for the
27 purpose of posing the following question:

1 Shall annual increases in Indian River County's
2 operating budget be limited to the percentage
3 change in the county's population plus the
4 percentage change in the Consumer Price Index
5 unless the county commission finds, by a super
6 majority vote, that exceeding the limitation is
7 necessary due to emergency or critical need?

10 (2) As used in this section, the term "qualified
11 elector" means a person who is registered to vote in a general
12 election held in Indian River County.
13 Section 3. This act, except for this section and
14 section 2, which shall take effect upon becoming a law, shall
15 take effect only upon its approval by a majority vote of those
16 qualified electors of Indian River County voting in a
17 referendum held in accordance with section 2.
