17 and insert:
18 Section 1. Section 267.076, Florida Statutes, is
19 created to read:
20 267.076 Confidentiality of certain donor information
21 related to publicly owned house museums designated as National
22 Historic Landmarks.--Information that would identify a donor
23 or prospective donor, who desires to remain anonymous, to a
24 publicly owned house museum designated by the United States
25 Department of the Interior as a National Historic Landmark, is
26 confidential and exempt from s. 119.07(1) and s. 24(a), Art. I
27 of the State Constitution. This section is subject to the Open
28 Government Sunset Review Act in accordance with s. 119.15, and
29 shall stand repealed on October 2, 2012, unless reviewed and
30 saved from repeal through reenactment by the Legislature.
31 Section 2. The Legislature finds that it is a public

1 necessity that information that would identify a donor or
2 prospective donor, who desires to remain anonymous, to a
3 publicly owned house museum designated by the United States
4 Department of the Interior as a National Historic Landmark, be
5 made confidential and exempt from public records requirements.
6 In order to protect Florida's historic resources, it is a
7 public necessity to promote the giving of gifts to, and the
8 raising of private funds for, the acquisition, renovation,
9 rehabilitation, and operation of publicly owned house museums
10 designated by the United States Department of the Interior as
11 National Historic Landmarks. An essential element of a robust
12 plan of promoting the giving of private gifts and the raising
13 of private funds is the need to protect the identity of
14 prospective and actual donors who desire to remain anonymous.
15 If the identity of prospective and actual donors who desire to
16 remain anonymous is subject to disclosure, there is a chilling
17 effect on donations because donors are concerned about
18 disclosure of personal information leading to theft and, in
19 particular, identity theft, including personal safety and
20 security. Therefore, the Legislature finds that it is a public
21 necessity to make confidential and exempt from public records
22 requirements information that would identify a donor or
23 prospective donor who wishes to remain anonymous, to a
24 publicly owned house museum designated by the United States
25 Department of the Interior as a National Historic Landmark.
26 Section 3. This act shall take effect July 1, 2007.
