  2         An act relating to public records; creating s.

  3         267.076, F.S.; creating an exemption from

  4         public-records requirements for information

  5         that identifies a donor or prospective donor

  6         information involving any publicly owned house

  7         museum that is designated by the United States

  8         Department of the Interior as a National

  9         Historic Landmark; providing for future

10         legislative review and repeal of the exemption

11         under the Open Government Sunset Review Act;

12         providing a finding of public necessity;

13         providing an effective date.

15  Be It Enacted by the Legislature of the State of Florida:

16  

17         Section 1.  Section 267.076, Florida Statutes, is

18  created to read:

19         267.076  Confidentiality of certain donor information

20  related to publicly owned house museums designated as National

21  Historic Landmarks.--Information that would identify a donor

22  or prospective donor, who desires to remain anonymous, to a

23  publicly owned house museum designated by the United States

24  Department of the Interior as a National Historic Landmark, is

25  confidential and exempt from s. 119.07(1) and s. 24(a), Art. I

26  of the State Constitution. This section is subject to the Open

27  Government Sunset Review Act in accordance with s. 119.15, and

28  shall stand repealed on October 2, 2012, unless reviewed and

29  saved from repeal through reenactment by the Legislature.

30         Section 2.  The Legislature finds that it is a public

31  necessity that information that would identify a donor or

 1  prospective donor, who desires to remain anonymous, to a

 2  publicly owned house museum designated by the United States

 3  Department of the Interior as a National Historic Landmark, be

 4  made confidential and exempt from public-records requirements.

 5  In order to protect Florida's historic resources, it is a

 6  public necessity to promote the giving of gifts to, and the

 7  raising of private funds for, the acquisition, renovation,

 8  rehabilitation, and operation of publicly owned house museums

 9  designated by the United States Department of the Interior as

10  National Historic Landmarks. An essential element of a robust

11  plan of promoting the giving of private gifts and the raising

12  of private funds is the need to protect the identity of

13  prospective and actual donors who desire to remain anonymous.

14  If the identity of prospective and actual donors who desire to

15  remain anonymous is subject to disclosure, there is a chilling

16  effect on donations because donors are concerned about

17  disclosure of personal information leading to theft and, in

18  particular, identity theft, including personal safety and

19  security. Therefore, the Legislature finds that it is a public

20  necessity to make confidential and exempt from public-records

21  requirements information that would identify a donor or

22  prospective donor who wishes to remain anonymous, to a

23  publicly owned house museum designated by the United States

24  Department of the Interior as a National Historic Landmark.

25         Section 3.  This act shall take effect July 1, 2007.

                       COMMITTEE SUBSTITUTE FOR
 2                         Senate Bill 2772

 4  The committee substitute eliminates the public meetings
    exemption provided in the original bill, and clarifies the
 5  public records exemption for information relating to donors or
    potential donors to publicly owned house museums designated as
 6  National Historic Landmarks, who desire to remain anonymous.
