  1                      A bill to be entitled

  2         An act relating to construction materials;

  3         defining the terms "agency" and "construction

  4         aggregate materials"; providing legislative

  5         intent; establishing the Strategic Aggregates

  6         Review Task Force; providing for membership,

  7         staffing, reporting, and expiration; requiring

  8         state agencies to consider the effect of

  9         decisionmaking on the availability of

10         construction aggregate materials; providing an

11         effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Construction aggregate materials.--

16         (1)  DEFINITIONS.--

17         (a)  "Agency" means:

18         1.  The Governor in the exercise of all executive

19  powers other than those derived from the constitution.

20         2.  Each:

21         a.  State officer and state department, and each

22  departmental unit described in s. 20.04.

23         b.  Authority, including a regional water supply

24  authority.

25         c.  Board.

26         d.  Commission, including the Commission on Ethics and

27  the Fish and Wildlife Conservation Commission when acting

28  pursuant to statutory authority derived from the Legislature.

29         e.  Regional planning agency.

30         f.  Multicounty special district of which a majority of

31  its governing board is comprised of nonelected persons.

 1         g.  Educational units.

 2         h.  Entity described in chapters 163, 373, 380, and 582

 3  and s. 186.504.

 4         3.  Each other unit of government in the state,

 5  including counties and municipalities.

 6         (b)  "Construction aggregate materials" means crushed

 7  stone, limestone, dolomite, limerock, shell rock, high-quality

 8  sand, and other mined resources providing the basic material

 9  for concrete, asphalt, and road base.

10         (2)  LEGISLATIVE INTENT.--The Legislature finds that

11  there is a strategic and critical need for an available supply

12  of construction aggregate materials within the state and

13  disruption of the supply would cause significant detriment to

14  the state's construction industry, transportation system, and

15  overall health, safety, and welfare of the state.

16         (3)  AGENCY DECISIONMAKING.--An agency considering a

17  proposed land use zoning change, comprehensive plan amendment,

18  land use permit decision, or order must address the affect

19  such change, amendment, permit decision, or order would have

20  on the availability, transportation, and potential extraction

21  of construction aggregate materials on the local area, the

22  region, and the state.

23         (4)  STRATEGIC AGGREGATES REVIEW TASK FORCE.--

24         (a)  The Strategic Aggregates Review Task Force is

25  created to evaluate the availability and disposition of

26  construction aggregate materials and related mining and land

27  use practices in this state.

28         (b)  The task force shall be appointed by August 1,

29  2007, and shall be composed of the following 15 members:

 1         1.  The President of the Senate, the Speaker of the

 2  House of Representatives, and the Governor shall each appoint

 3  one member from each of the following groups:

 4         a.  The mining or construction industries.

 5         b.  The transportation industries, including seaports,

 6  trucking, railroads, or roadbuilders.

 7         c.  Elected county government.

 8         d.  Environmental advocacy groups.

 9         2.  The Secretary of Environmental Protection or

10  designee.

11         3.  The Secretary of Community Affairs or designee.

12         4.  The Secretary of Transportation or designee.

13         (c)  Members of the commission shall serve without

14  compensation. Travel and per diem expenses for members who are

15  not state employees shall be paid by the Department of

16  Transportation in accordance with s. 112.061, Florida

17  Statutes.

18         (d)  The Department of Community Affairs shall organize

19  and provide administrative support for the task force and

20  coordinate with other state agencies and local governments in

21  obtaining and providing such data and information as may be

22  needed by the task force to complete its evaluation. The

23  department may conduct any supporting studies as are required

24  to obtain needed information or otherwise assist the task

25  force in its review and deliberations.

26         (e)  The Department of Transportation shall collect and

27  provide information to the task force relating to construction

28  aggregate materials and the amount of such materials used by

29  the department on state road infrastructure projects, and

30  shall provide any technical and supporting information

 1  relating to the use of such materials as is available to the

 2  department.

 3         (f)  The task force shall report its findings to the

 4  Governor, the President of the Senate, and the Speaker of the

 5  House of Representatives by December 15, 2007. The report must

 6  identify locations with significant concentrations of

 7  construction aggregate materials and recommend actions

 8  intended to ensure the continued extraction and availability

 9  of construction aggregate materials.

10         (g)  The task force shall be dissolved on July 1, 2008.

11         Section 2.  This act shall take effect upon becoming a

12  law.
