12 (Saunders) recommended the following amendment:

14 Senate Amendment (with title amendment)
15 On page 26, between lines 25 and 26,
16
17 insert:
18 Section 17. Section 337.026, Florida Statutes, is
19 created to read:
20 337.026 Authority of department to enter into
21 agreements for construction aggregate materials.--
22 (1) The department may pursue innovative contractual
23 or engineering techniques that will provide reliable and
24 economic supplies of construction aggregate materials and that
25 control time and cost increases on construction projects.
26 (2) The department may enter into agreements with
27 private or public entities. Such agreements may include, but
28 are not limited to, acquisition of materials or resources or
29 long-term leases for terms not to exceed 99 years which will
30 advance the state's transportation needs.
31 (3) To the maximum extent practicable, the department

1 must use the existing process to award and administer such
2 contractual or engineering techniques. When specific
3 contractual or engineering techniques are to be used, the
4 department is not required to adhere to provisions of law that
5 would prevent, preclude, or prohibit it from using the
6 contractual or engineering technique. However, prior to using
7 an innovative contractual or engineering technique that is
8 inconsistent with another provision of law, the department
9 must document in writing the need for the exception and
10 specify the benefits that the traveling public and the
11 affected community are anticipated to receive.
12 (4) The Department of Transportation's District 1
13 shall, as a pilot project, coordinate with any applicable
14 regional planning council, metropolitan planning organization,
15 or local government to facilitate and expedite the approval of
16 the extraction of the construction aggregate materials.
