12 Appropriations (Webster) recommended the following amendment:

15 On page 26, lines 6-30,

17 and insert:
18 Section 17. Section 337.026, Florida Statutes, is
19 created to read:
20 337.026 Authority of department to enter into
21 agreements for construction aggregate materials.--
22 (1) The department may pursue procurement techniques
23 that will provide reliable and economic supplies of
24 construction aggregate materials and that control time and
25 cost increases on construction projects.
26 (2) The department may enter into agreements with
27 private or public entities. Such agreements may include, but
28 are not limited to, acquisition of materials or resources or
29 long-term leases for terms not to exceed 99 years which will
30 advance the state's transportation needs.
31 (3) To the maximum extent practicable, the department

1 must use the existing process to administer such procurement
2 techniques. When procurement techniques authorized by this
3 section are to be used, the department is not required to
4 adhere to provisions of law that would prevent, preclude, or
5 prohibit it from using this procurement technique. However,
6 prior to using this procurement technique, the department must
7 document in writing the need for the exception and specify the
8 benefits that the traveling public and the affected community
9 are anticipated to receive.
