  1                      A bill to be entitled

  2         An act relating to designated drivers; amending

  3         s. 562.51, F.S.; prohibiting a licensed retail

  4         alcohol beverage establishment open to the

  5         public from denying service to a designated

  6         driver; providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Section 562.51, Florida Statutes, is

11  amended to read:

12         562.51  Retail alcoholic beverage establishments;

13  rights as private enterprise.--A licensed retail alcoholic

14  beverage establishment open to the public is a private

15  enterprise and:

16         (1)  May refuse service to any person who is

17  objectionable or undesirable to the licensee, but such refusal

18  of service shall not be on the basis of race, creed, color,

19  religion, sex, national origin, marital status, or physical

20  handicap.

21         (2)(a)  May not refuse service to any person solely

22  because the person is not purchasing alcoholic beverages if

23  that person is the designated driver for one or more persons

24  who are purchasing alcoholic beverages at the establishment.

25         (b)  This subsection does not excuse a retail alcoholic

26  beverage establishment from complying with any applicable

27  municipal or county ordinance regulating the presence of

28  persons under 21 years of age on the premises of any such

29  establishment.

30         Section 2.  This act shall take effect October 1, 2007.
