1 A bill to be entitled
2 An act relating to renewable energy; amending
3 s. 377.803, F.S.; defining the term "net
4 metering"; creating s. 377.805, F.S.; providing
5 a short title; directing the Public Service
6 Commission and the Department of Environmental
7 Protection to develop rules requiring all
8 electric utilities to develop net metering
9 programs; providing for a customer to receive
10 credit for electricity generated by renewable
11 energy systems owned by the customer; directing
12 the commission and department to adopt rules
13 setting the standards renewable energy systems
14 must meet for customers to qualify for the
15 program; providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:

19 Section 1. Subsections (5) through (10) of section
20 377.803, Florida Statutes, are renumbered as subsections (6)
21 through (11), respectively, and a new subsection (5) is added
22 to that section to read:
23 377.803 Definitions.--As used in ss. 377.801-377.806,
24 the term:
25 (5) "Net metering" means a process by which an
26 electric utility buys back energy produced by a customer who
27 uses one or more renewable energy systems and produces more
28 energy than he or she uses.
29 Section 2. Section 377.805, Florida Statutes, is
30 created to read:
31 377.805 Electric utilities; net metering.--

1 (1) This section may be cited as the "Florida Net
2 Metering Conservation Act."
3 (2) The commission and the department shall develop
4 rules requiring all electric utilities to develop net metering
5 programs that meet the requirements of this subsection. The
6 utilities shall make available meters that run backwards when
7 a customer produces more energy than the customer uses. The
8 customer shall receive credit at the full retail rate for
9 energy generated by eligible systems. If the customer's system
10 generates more energy than the customer consumes during a
11 billing cycle, the customer shall pay only the basic charge
12 for service and the excess credit shall be carried forward to
13 the following billing cycle.
14 (3) The commission and the department shall develop
15 rules setting the standards renewable energy systems must meet
16 for customers to be eligible to participate in the net
17 metering program.
18 Section 3. This act shall take effect upon becoming a
19 law.
