1 A bill to be entitled
2 An act relating to the K-8 Virtual School
3 Program; amending s. 1002.415, F.S.; expanding
4 student eligibility for the program; providing
5 an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Paragraph (a) of subsection (5) of section
10 1002.415, Florida Statutes, is amended to read:
11 1002.415 K-8 Virtual School Program.--Subject to
12 annual legislative appropriation, a kindergarten through grade
13 8 virtual school program is established within the Department
14 of Education for the purpose of making academic instruction
15 available to full-time students in kindergarten through grade
16 8 using on-line and distance learning technology. The
17 department shall use an application process to select schools
18 to deliver program instruction.
19 (5) STUDENT ELIGIBILITY.--
20 (a) Enrollment in each participating school is open to
21 any K-8 student in this state if the student meets at least
22 one of the following conditions:
23 1. Complied during the prior school year with the
24 regular school attendance requirements of chapter 1003 Spent
25 the prior school year in attendance at a public school in this
26 state and was enrolled and reported by a public school
27 district for funding during the preceding October and February
28 for purposes of the Florida Education Finance Program surveys;
29 2. Was enrolled during the prior school year in a K-8
30 virtual school funded pursuant to this section or from funds
31 provided in the 2005 General Appropriations Act;

1 3. Is eligible to enroll in kindergarten or the first
2 grade; or
3 4. Has a sibling who is currently enrolled in a
4 participating K-8 virtual school and was enrolled at the end
5 of the prior school year.
6 Section 2. This act shall take effect July 1, 2007.
