  1                      A bill to be entitled

  2         An act relating to municipal incorporation;

  3         prohibiting counties from requiring certain

  4         municipalities to pay charges, assessments,

  5         taxes, fees, or other consideration for certain

  6         residents' actions; providing that the

  7         provisions of the act are not preempted by law;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Notwithstanding s. 165.022, Florida

13  Statutes, any municipality formed after January 1, 2000, and

14  any municipality formed on or after July 1, 2007, may not be

15  required to pay any charge, assessment, tax, fee, or other

16  consideration as a condition for allowing the citizens of an

17  area to incorporate and govern themselves.

18         Section 2.  This act shall take effect July 1, 2007.

                       COMMITTEE SUBSTITUTE FOR
21                         Senate Bill 2848

23  The committee substitute (CS) prohibits a county from
    requiring a municipality formed after January 1, 2000, to pay
24  a charge, assessment, tax, fee, or other consideration as a
    condition of incorporation. This is a change from the bill as
25  filed which applied the prohibition to any municipality formed
    after January 1, 2002. The CS also moves this prohibition from
26  s. 125.0101, F.S., to an unnumbered section of law.
