11  The Committee on Regulated Industries (King) recommended the
12  following amendment:
13  
14         Senate Amendment (with title amendment) 
15         On page 6, between lines 14 and 15,
16  
17  insert:  
18         Section 5.  Subsection (6) is added to section 497.270,
19  Florida Statutes, to read:
20         497.270  Minimum acreage; sale or disposition of
21  cemetery lands.--
22         (6)  Except for a road system or a transportation
23  corridor, or for right-of-way purposes, property dedicated for
24  use as a cemetery and licensed under this part may not be
25  taken by eminent domain if the area of the property is one 1
26  contiguous acre or more, unless the taking entity determines
27  in a public hearing that there is no reasonable alternative. A
28  governmental entity may not require the transfer of property
29  dedicated for cemetery purposes and licensed as of July 1,
30  2007, as a condition of obtaining approval for any regulatory
31  requirement to which the cemetery is subject.

10         amending s. 497.270, F.S.; prohibiting taking

13         circumstances; providing that transferring
14         property licensed by a certain date cannot be a
15         condition of obtaining regulatory approval;
