1 A bill to be entitled
2 An act relating to the Florida Schools of
3 Excellence Commission; repealing s. 1002.335,
4 F.S., which establishes the Florida Schools of
5 Excellence Commission; amending s. 1002.33,
6 F.S.; conforming provisions; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 1002.335, Florida Statutes, is
12 repealed.
13 Section 2. Paragraphs (e) through (i) of subsection
14 (6) of section 1002.33, Florida Statutes, are redesignated as
15 paragraphs (d) through (h), respectively, and present
16 paragraph (d) of that subsection is amended to read:
17 1002.33 Charter schools.--
18 (6) APPLICATION PROCESS AND REVIEW.--Charter school
19 applications are subject to the following requirements:
20 (d) For charter school applications in school
21 districts that have not been granted exclusive authority to
22 sponsor charter schools pursuant to s. 1002.335(5), the right
23 to appeal an application denial under paragraph (c) shall be
24 contingent on the applicant having submitted the same or a
25 substantially similar application to the Florida Schools of
26 Excellence Commission or one of its cosponsors. Any such
27 applicant whose application is denied by the commission or one
28 of its cosponsors subsequent to its denial by the district
29 school board may exercise its right to appeal the district
30 school board's denial under paragraph (c) within 30 days after
31 receipt of the commission's or cosponsor's denial or failure

1 to act on the application. However, the applicant forfeits its
2 right to appeal under paragraph (c) if it fails to submit its
3 application to the commission or one of its cosponsors by
4 August 1 of the school year immediately following the district
5 school board's denial of the application.
6 Section 3. This act shall take effect July 1, 2007.
