2 An act relating to the Lealman Special Fire
3 Control District, Pinellas County; creating a
4 task force to review provisions governing
5 authority over district lands annexed by
6 municipalities or other fire control districts;
7 providing for membership and meetings of the
8 task force; requiring the hiring of a
9 professional facilitator; requiring a report;
10 amending chapter 2000-426, Laws of Florida, as
11 amended, to defer the future repeal of
12 provisions granting the district taxing,
13 enforcement, and service-providing authority
14 over district lands annexed by municipalities
15 or other fire control districts; repealing
16 sections 3 and 4 of chapter 2002-352, Laws of
17 Florida, to conform; providing effective dates.

19 Be It Enacted by the Legislature of the State of Florida:
20
21 Section 1. Lealman Special Fire Control District Task
22 Force.--
23 (1) There is created the Lealman Special Fire Control
24 District Task Force. The task force shall consist of the chair
25 of the Lealman Fire Control District Board of Supervisors; one
26 member appointed jointly by the Mayor of the City of Pinellas
27 Park, the Mayor of the City of St. Petersburg, the Mayor of
28 Kenneth City, and the Mayor of the City of Seminole,
29 representing one vote; and one member of the Pinellas County
30 Board of County Commissioners appointed by the chair of the
31 Pinellas County Board of County Commissioners.

1 (2) The task force shall initially meet not later than
2 30 days after the effective date of this act to organize and
3 elect a chair from its members. The task force shall meet
4 subsequently at the call of the chair but not less than twice
5 a year.
6 (3) The task force shall review the changes to
7 sections 3(2) and 11 of section 1 of chapter 2000-426, Laws of
8 Florida, made by sections 1 and 2 of chapter 2002-352, Laws of
9 Florida, which granted the district taxing, enforcing, and
10 service-providing authority over district lands annexed by any
11 municipality or other fire control district, and shall
12 consider whether the future repeal of those changes as
13 provided in this act should be rescinded. From district funds,
14 the task force shall hire a professional facilitator who has
15 experience with local government to assist it in this review.
16 (4) The task force shall provide a report with its
17 findings and recommendations to the Pinellas County
18 Legislative Delegation no later than November 1, 2007.
19 Section 2. Effective July 1, 2008, subsection (2) of
20 section 3 of section 1 of chapter 2000-426, Laws of Florida,
21 as amended by section 1 of chapter 2002-352, Laws of Florida,
22 is amended to read:
23 Section 3. Formation; boundaries.--
24 (2) Any lands within a municipality included in the
25 boundaries of the District, as described herein, shall be
26 excluded from the District and its jurisdiction. If any area,
27 tract, or parcel of land within the boundaries of the District
28 shall hereafter become annexed to a municipality, such area,
29 tract, or parcel of land shall be excluded from the District
30 effective the next January 1 following such annexation by a

1 municipality; however, the District shall continue to provide
2 services to the annexed area pursuant to section 11.
3 Section 3. Effective July 1, 2008, section 11 of
4 section 1 of chapter 2000-426, Laws of Florida, as amended by
5 section 2 of chapter 2002-352, Laws of Florida, is amended to
6 read:
7 Section 11. Annexation of territories by
8 municipalities or other fire control districts.--For the
9 purposes and requirements of this Act, after the annexation by
10 a municipality of any unincorporated area within the Lealman
11 Special Fire Control District, the annexed area shall be
12 treated as lying within the corporate boundaries of the
13 annexing municipality and shall not be subject to a levy of
14 the ad valorem tax that is authorized by this Act.
15 Notwithstanding chapter 171, Florida Statutes, or any other
16 applicable law or ordinance, if any municipality or other fire
17 control district annexes land within the District, the
18 District shall continue as the sole taxing, enforcing, and
19 service-providing authority for District purposes in the
20 annexed land. However, any municipality or other fire control
21 district that annexes such land may collect the applicable
22 assessment or tax for fire services and pay the District for
23 such services at the District's annually adopted standard
24 rate.
25 Section 4. Sections 3 and 4 of chapter 2002-352, Laws
26 of Florida, are repealed.
27 Section 5. Except as otherwise expressly provided in
28 this act, this act shall take effect upon becoming a law.
