1 A bill to be entitled
2 An act relating to the Hillsborough County
3 Aviation Authority; amending chapter 2003-370,
4 Laws of Florida, relating to the award of
5 contracts; increasing the minimum amount at
6 which certain contracts are subject to
7 competitive bidding or require sureties;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Paragraphs (a), (b), and (c) of subsection
13 (1) of section 11 of section 3 of chapter 2003-370, Laws of
14 Florida, are amended to read:
15 Section 11. Award of contracts.--
16 (1)(a) Except when done by employees of the Authority
17 or by labor supplied under agreement with the federal, state,
18 or local government or when required by or using the
19 Consultants' Competitive Negotiation Act, all construction,
20 improvements, repairs, or work of any nature done by the
21 Authority, where the entire cost or value exceeds $30,000
22 $15,000, shall be done only under contract or contracts
23 entered into by the Authority with the lowest responsive bid
24 from a qualified responsible bidder upon proper terms, after
25 advertisement has been given asking for competitive bids,
26 provided that the Authority may reject any and all bids.
27 (b) Any contract subject to section 255.05, Florida
28 Statutes, as may be amended from time to time, in excess of
29 $50,000 $15,000 shall not be entered into for construction,
30 improvement, or repair of Authority facilities unless the
31 contractor has sufficient surety or sureties, approved by the

1 Authority, and in an amount fixed by the Authority, for the
2 faithful performance of the contract. Any such contract shall
3 include provisions that the person entering into the contract
4 with the Authority will pay for all materials furnished and
5 services rendered for the performance of the contract and may
6 maintain an action to recover for the same against the obligor
7 in the undertaking, as though such person was named therein,
8 provided the action is brought within 1 year after the time
9 the cause of action accrued. Nothing in this section shall be
10 construed to limit the power of the Authority to construct,
11 repair, or improve Authority facilities or any addition,
12 betterment, or extension thereto, directly by the officers,
13 agents, and employees of the Authority, or otherwise than by
14 contract.
15 (c) All supplies and materials costing in excess of
16 $30,000 $15,000 shall be purchased only after advertisement.
17 The Authority shall accept the lowest responsive bid from a
18 responsible bidder, kind, quality, and material being equal,
19 but the Authority has the right to reject any or all bids or
20 select a single item from any bid.
21 Section 2. This act shall take effect upon becoming a
22 law.
