  1                      A bill to be entitled

  2         An act relating to Hillsborough County;

  3         amending chapter 2001-299, Laws of Florida;

  4         granting the Hillsborough County Public

  5         Transportation Commission rulemaking authority

  6         regarding the availability of certain public

  7         vehicles for individuals with mobility

  8         impairments; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Paragraph (oo) of subsection (2) of section

13  5 of chapter 2001-299, Laws of Florida, is redesignated as

14  paragraph (pp), and a new paragraph (oo) is added to that

15  subsection to read:

16         Section 5.  Commission powers, mandatory and

17  discretionary.--

18         (2)  The commission has the power to:

19         (oo)  Adopt a rule ensuring the availability of public

20  vehicles that meet any applicable federal requirements for the

21  transportation of any individual with mobility impairments who

22  cannot transfer to a passenger seat and is restricted to a

23  common wheelchair as defined by federal law. In no case shall

24  this rule require more than 3 percent of the total authorized

25  permits issued under a certificate.

26         Section 2.  This act shall take effect July 1, 2007.
