11 | Be It Enacted by the Legislature of the State of Florida: |
12 |

13 | Section 1. This act may be cited as the "Healthy Dining |
14 | Act." |
15 | Section 2. Section 509.293, Florida Statutes, is created |
16 | to read: |
17 | 509.293 Disclosure of food containing trans fats.-- |
18 | (1) Any public food service establishment that prepares, |
19 | serves, or sells food that contains trans fats or has been |
20 | prepared with substances that contain trans fats shall post the |
21 | following disclosure in a conspicuous location: "Some foods |
22 | served here contain trans fats. Eating foods with trans fats can |
23 | increase your risk of stroke and heart attack." |
24 | (2) The division shall enforce the requirements of this |
25 | section. |
26 | (3) Any operator of any food service establishment who |
27 | violates, or causes to be violated, the provisions of this |
28 | section commits a misdemeanor of the second degree, punishable |
29 | as provided in s. 775.082 or s. 775.083. In addition to the |
30 | criminal penalty, the license of any food service establishment |
31 | may be suspended or revoked by the division, or the division may |
32 | impose fines on the licensee, in accordance with the provisions |
33 | of s. 509.261, when the operator of such establishment is |
34 | determined by the division to have violated any provision of |
35 | this section. It is not necessary that the offender be convicted |
36 | of violating this section as a condition precedent to the |
37 | suspension or revocation of such license or the imposition of a |
38 | civil penalty by the division. |
39 | Section 3. This act shall take effect July 1, 2007. |
