1 A bill to be entitled
2 An act relating to a motor vehicle safety pilot
3 program; requiring certain limited access
4 facilities that are adjacent to a canal or
5 other water body to have a system of
6 guardrails, retention cables, or other barriers
7 between the highway and the canal or water
8 body; providing for the Department of
9 Transportation to establish certain standards
10 governing the installation and maintenance of
11 the barriers; requiring that barriers be
12 installed for existing highways by a specified
13 date; providing for future review and repeal;
14 providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Barrier required between a highway and a
19 canal or a water body.--
20 (1) Each limited access facility in Miami-Dade County
21 that is adjacent to a canal or other water body must have a
22 system of guardrails, retention cables, or other barriers
23 between the highway and the canal or water body which are
24 installed and maintained in conformance with standards
25 established by the Department of Transportation. The standards
26 should consider loss of life by safely preventing
27 out-of-control motor vehicles from entering the canal or water
28 body, as well as the width or depth of the canal or water body
29 or its proximity to the traveled way of the highway.

1 (2) For a limited access facility in existence on July
2 1, 2007, the barriers required under this section must be
3 installed on or before December 31, 2010.
4 (3) This pilot program shall stand repealed December
5 31, 2011, unless reviewed and saved from repeal through
6 enactment by the Legislature.
7 Section 2. This act shall take effect July 1, 2007.

COMMITTEE SUBSTITUTE FOR

12 This Committee Substitute (CS) provides for each limited
access facility in Miami-Dade County adjacent to a canal or
13 body of water to have a system of guardrails, retention
cables, or other barriers between a highway and canal or other
14 body of water. In addition, the CS provides for installation
of barriers by December 31, 2010 for any affected limited
15 access facility in existence as of July 1, 2007. The CS
further provides for the repeal of the pilot program on
16 December 31, 2011 unless reviewed and saved from repeal by the
Legislature.
