A bill to be entitled
2An act relating to federal law enforcement officers;
3amending s. 784.07, F.S.; redefining the term "law
4enforcement officer" to include a federal law enforcement
5officer for purposes of certain enhanced penalties imposed
6for the offense of assault or battery of a law enforcement
7officer; amending s. 843.08, F.S.; adding federal law
8enforcement officer to offense of false personation;
9reenacting ss. 435.04(3)(a), 901.15(15), 921.0022(3)(b),
10(d), (f), and (g), 943.051(3)(b), and 985.11(1)(b), F.S.,
11relating to screening standards, arrest without warrant,
12the offense severity ranking chart, and the fingerprinting
13of minors, to incorporate the amendments to ss. 784.07 and
14843.08, F.S., in references thereto; providing an
15effective date.

17Be It Enacted by the Legislature of the State of Florida:
18
19     Section 1.  Paragraph (a) of subsection (1) of section
20784.07, Florida Statutes, is amended, and subsections (2) and
21(3) of that section are reenacted, to read:
22     784.07  Assault or battery of law enforcement officers,
23firefighters, emergency medical care providers, public transit
24employees or agents, or other specified officers;
25reclassification of offenses; minimum sentences.--
26     (1)  As used in this section, the term:
27     (a)  "Law enforcement officer" includes a law enforcement
28officer, a correctional officer, a correctional probation
29officer, a part-time law enforcement officer, a part-time
30correctional officer, an auxiliary law enforcement officer, and
31an auxiliary correctional officer, as those terms are
32respectively defined in s. 943.10, and any county probation
33officer; an employee or agent of the Department of Corrections
34who supervises or provides services to inmates; an officer of
35the Parole Commission; a federal law enforcement officer as
36defined in s. 901.1505; and law enforcement personnel of the
37Fish and Wildlife Conservation Commission, the Department of
38Environmental Protection, or the Department of Law Enforcement.
39     (2)  Whenever any person is charged with knowingly
40committing an assault or battery upon a law enforcement officer,
41a firefighter, an emergency medical care provider, a traffic
42accident investigation officer as described in s. 316.640, a
43nonsworn law enforcement agency employee who is certified as an
44agency inspector, blood alcohol analyst, or a breath test
45operator while such employee is in uniform and engaged in
46processing, testing, evaluating, analyzing, or transporting a
47person who is detained or under arrest for DUI, a traffic
48infraction enforcement officer as described in s. 316.640, a
49parking enforcement specialist as defined in s. 316.640, a
50person licensed as a security officer as defined in s. 493.6101
51and wearing a uniform that bears at least one patch or emblem
52that is visible at all times that clearly identifies the
53employing agency and that clearly identifies the person as a
54licensed security officer, or a security officer employed by the
55board of trustees of a community college, while the officer,
56firefighter, emergency medical care provider, intake officer,
57traffic accident investigation officer, traffic infraction
58enforcement officer, inspector, analyst, operator, parking
59enforcement specialist, public transit employee or agent, or
60security officer is engaged in the lawful performance of his or
61her duties, the offense for which the person is charged shall be
62reclassified as follows:
63     (a)  In the case of assault, from a misdemeanor of the
64second degree to a misdemeanor of the first degree.
65     (b)  In the case of battery, from a misdemeanor of the
66first degree to a felony of the third degree.
67     (c)  In the case of aggravated assault, from a felony of
68the third degree to a felony of the second degree.
69Notwithstanding any other provision of law, any person convicted
70of aggravated assault upon a law enforcement officer shall be
71sentenced to a minimum term of imprisonment of 3 years.
72     (d)  In the case of aggravated battery, from a felony of
73the second degree to a felony of the first degree.
74Notwithstanding any other provision of law, any person convicted
75of aggravated battery of a law enforcement officer shall be
76sentenced to a minimum term of imprisonment of 5 years.
77     (3)  Any person who is convicted of a battery under
78paragraph (2)(b) and, during the commission of the offense, such
79person possessed:
80     (a)  A "firearm" or "destructive device" as those terms are
81defined in s. 790.001, shall be sentenced to a minimum term of
82imprisonment of 3 years.
83     (b)  A semiautomatic firearm and its high-capacity
84detachable box magazine, as defined in s. 775.087(3), or a
85machine gun as defined in s. 790.001, shall be sentenced to a
86minimum term of imprisonment of 8 years.

88Notwithstanding s. 948.01, adjudication of guilt or imposition
89of sentence shall not be suspended, deferred, or withheld, and
90the defendant is not eligible for statutory gain-time under s.
91944.275 or any form of discretionary early release, other than
92pardon or executive clemency, or conditional medical release
93under s. 947.149, prior to serving the minimum sentence.
94     Section 2.  Section 843.08, Florida Statutes, is amended to
95read:
96     843.08  Falsely personating officer, etc.--A person who
97falsely assumes or pretends to be a sheriff, officer of the
98Florida Highway Patrol, officer of the Fish and Wildlife
99Conservation Commission, officer of the Department of
100Environmental Protection, officer of the Department of
101Transportation, officer of the Department of Financial Services,
102officer of the Department of Corrections, correctional probation
103officer, deputy sheriff, state attorney or assistant state
104attorney, statewide prosecutor or assistant statewide
105prosecutor, state attorney investigator, coroner, police
106officer, lottery special agent or lottery investigator, beverage
107enforcement agent, or watchman, or any member of the Parole
108Commission and any administrative aide or supervisor employed by
109the commission, or any personnel or representative of the
110Department of Law Enforcement, or a federal law enforcement
111officer as defined in s. 901.1505, and takes upon himself or
112herself to act as such, or to require any other person to aid or
113assist him or her in a matter pertaining to the duty of any such
114officer, commits a felony of the third degree, punishable as
115provided in s. 775.082, s. 775.083, or s. 775.084; however, a
116person who falsely personates any such officer during the course
117of the commission of a felony commits a felony of the second
118degree, punishable as provided in s. 775.082, s. 775.083, or s.
119775.084; except that if the commission of the felony results in
120the death or personal injury of another human being, the person
121commits a felony of the first degree, punishable as provided in
122s. 775.082, s. 775.083, or s. 775.084.
123     Section 3.  For the purpose of incorporating the amendment
124made by this act to section 784.07, Florida Statutes, in a
125reference thereto, paragraph (a) of subsection (3) of section
126435.04, Florida Statutes, is reenacted to read:
127     435.04  Level 2 screening standards.--
128     (3)  The security background investigations conducted under
129this section for employees of the Department of Juvenile Justice
130must ensure that no persons subject to the provisions of this
131section have been found guilty of, regardless of adjudication,
132or entered a plea of nolo contendere or guilty to, any offense
133prohibited under any of the following provisions of the Florida
134Statutes or under any similar statute of another jurisdiction:
135     (a)  Section 784.07, relating to assault or battery of law
136enforcement officers, firefighters, emergency medical care
137providers, public transit employees or agents, or other
138specified officers.

140The Department of Juvenile Justice may not remove a
141disqualification from employment or grant an exemption to any
142person who is disqualified under this section for any offense
143disposed of during the most recent 7-year period.
144     Section 4.  For the purpose of incorporating the amendment
145made by this act to section 784.07, Florida Statutes, in a
146reference thereto, subsection (15) of section 901.15, Florida
147Statutes, is reenacted to read:
148     901.15  When arrest by officer without warrant is
149lawful.--A law enforcement officer may arrest a person without a
150warrant when:
151     (15)  There is probable cause to believe that the person
152has committed assault upon a law enforcement officer, a
153firefighter, an emergency medical care provider, public transit
154employees or agents, or other specified officers as set forth in
155s. 784.07 or has committed assault or battery upon any employee
156of a receiving facility as defined in s. 394.455 who is engaged
157in the lawful performance of his or her duties.
158     Section 5.  For the purpose of incorporating the amendment
159made by this act to section 843.08, Florida Statutes, in a
160reference thereto, paragraph (b) of subsection (3) of section
161921.0022, Florida Statutes is reenacted, and for the purpose of
162incorporating the amendment made by this act to section 784.07,
163Florida Statutes, in references thereto, paragraphs (d), (f),
164and (g) of subsection (3) of that section are reenacted, to
165read:

468A law enforcement agency may fingerprint and photograph a child
469taken into custody upon probable cause that such child has
470committed any other violation of law, as the agency deems
471appropriate. Such fingerprint records and photographs shall be
472retained by the law enforcement agency in a separate file, and
473these records and all copies thereof must be marked "Juvenile
474Confidential." These records are not available for public
475disclosure and inspection under s. 119.07(1) except as provided
476in ss. 943.053 and 985.04(2), but shall be available to other
477law enforcement agencies, criminal justice agencies, state
478attorneys, the courts, the child, the parents or legal
479custodians of the child, their attorneys, and any other person
480authorized by the court to have access to such records. In
481addition, such records may be submitted to the Department of Law
482Enforcement for inclusion in the state criminal history records
483and used by criminal justice agencies for criminal justice
484purposes. These records may, in the discretion of the court, be
485open to inspection by anyone upon a showing of cause. The
486fingerprint and photograph records shall be produced in the
487court whenever directed by the court. Any photograph taken
488pursuant to this section may be shown by a law enforcement
489officer to any victim or witness of a crime for the purpose of
490identifying the person who committed such crime.
491     Section 8.  This act shall take effect July 1, 2007.
