2An act relating to concordant assessment scores for the
3Florida Comprehensive Assessment Test; amending s.
41008.22, F.S.; providing that certain concordant subject
5area scores satisfy various assessment requirements
6concerning graduation from high school; exempting a
7student who attains a concordant subject area score from
8taking the FCAT in that subject area; amending s.
91003.429, F.S.; providing for the retention of a student
10in the accelerated 3-year graduation option who achieves a
11certain concordant score; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Paragraph (b) of subsection (9) of section
161008.22, Florida Statutes, is amended to read:
17     1008.22  Student assessment program for public schools.--
18     (9)  CONCORDANT SCORES FOR THE FCAT.--
19     (b)  In order to use A student who attains a concordant
20subject area score pursuant to this subsection satisfies to
21satisfy the assessment requirement in that subject area for a
22standard high school diploma as provided in s. 1003.429(6)(a),
23s. 1003.43(5)(a), or s. 1003.428 and, notwithstanding any other
24law, may not be required to take the FCAT in that subject area.,
25a student must take each subject area of the grade 10 FCAT a
26total of three times without earning a passing score. The
27requirements of this paragraph shall not apply to a new student
28who enters the Florida public school system in grade 12, who may
29either achieve a passing score on the FCAT or use an approved
30subject area concordant score to fulfill the graduation
31requirement.
32     Section 2.  Subsection (8) of section 1003.429, Florida
33Statutes, is amended to read:
34     1003.429  Accelerated high school graduation options.--
35     (8)  A student who selected one of the accelerated 3-year
36graduation options shall automatically move to the 4-year
37program set forth in s. 1003.43 if the student:
38     (a)  Exercises his or her right to change to the 4-year
39program;
40     (b)  Fails to earn 5 credits by the end of grade 9 or fails
41to earn 11 credits by the end of grade 10;
42     (c)  Does not attain achieve a score of 3 or higher on the
43grade 10 FCAT Writing assessment or a concordant score as
44described in s. 1008.22(9); or
45     (d)  By the end of grade 11 does not meet the requirements
46of subsections (1) and (6).
47     Section 3.  This act shall take effect July 1, 2007.
