1 A bill to be entitled
2 An act relating to infant eye care; amending s.
3 383.04, F.S.; requiring certain eye
4 examinations for all infants born in hospitals
5 in the state; exempting this requirement from
6 s. 383.07, F.S., relating to a penalty;
7 revising an exception to certain applicability
8 requirements concerning infant eye care;
9 amending ss. 627.6416 and 641.31, F.S.;
10 providing that coverage for children under
11 health insurance policies and health
12 maintenance organization contracts must include
13 certain eye examinations for infants and
14 children; providing that the act fulfills an
15 important state interest; providing for
16 application; providing an effective date.

18 Be It Enacted by the Legislature of the State of Florida:
19
20 Section 1. Section 383.04, Florida Statutes, is
21 amended to read:
22 383.04 Prophylactic required for eyes of
23 infants.--Every physician, midwife, or other person in
24 attendance at the birth of a child in the state shall is
25 required to instill or have instilled into the eyes of the
26 baby within 1 hour after birth an effective prophylactic
27 recommended by the Committee on Infectious Diseases of the
28 American Academy of Pediatrics for the prevention of neonatal
29 ophthalmia. In addition, each baby born in a hospital in the
30 state must, before being discharged from the hospital, receive
31 an eye examination using an opthalmoscope and dilation of the

1 pupils for detection of pediatric congenital and ocular
2 abnormalities; however, this requirement is not subject to s.
3 383.07. This section does not apply to cases where the parents
4 file written objections with the physician, midwife, or other
5 person in attendance at the birth of a child written
6 objections on account of religious beliefs contrary to the use
7 of drugs. In such case the physician, midwife, or other
8 person in attendance shall maintain a record that such
9 measures were or were not employed and attach thereto any
10 written objection.
11 Section 2. Paragraph (a) of subsection (2) of section
12 627.6416, Florida Statutes, is amended to read:
13 627.6416 Coverage for child health supervision
14 services.--
15 (2) As used in this section, the term "child health
16 supervision services" means physician-delivered or
17 physician-supervised services that include, at a minimum,
18 services delivered at the intervals and scope stated in this
19 section.
20 (a) Child health supervision services must include
21 periodic visits that which shall include a history;, a
22 physical examination;, a developmental assessment and
23 anticipatory guidance;, and appropriate immunizations and
24 laboratory tests; and eye examinations at birth, at 6 to 8
25 weeks of age, and at 6 to 9 months of age, using an
26 opthalmoscope and dilation of the pupils for detection of
27 pediatric congenital and ocular abnormalities and
28 developmental abnormalities. Such services and periodic
29 visits shall be provided in accordance with prevailing medical
30 standards consistent with the Recommendations for Preventive
31 Pediatric Health Care of the American Academy of Pediatrics.

1 Section 3. Subsection (30) of section 641.31, Florida
2 Statutes, is amended to read:
3 641.31 Health maintenance contracts.--
4 (30)(a) All health maintenance contracts which provide
5 coverage, benefits, or services for a member of the family of
6 the subscriber must, as to such family member's coverage,
7 benefits, or services, also provide that the benefits
8 applicable for children include coverage for child health
9 supervision services from the moment of birth to age 16 years.
10 (b) As used in this subsection, the term "child health
11 supervision services" means physician-delivered or
12 physician-supervised services that include, at a minimum,
13 services delivered at the intervals and scope stated in this
14 subsection.
15 1. Child health supervision services must include

27 2. Minimum benefits may be limited to one visit
28 payable to one provider for all of the services provided at
29 each visit cited in this subsection.
30 Section 4. The Legislature finds that this act
31 fulfills an important state interest.

1 Section 5. This act shall take effect July 1, 2007,
2 and applies to policies and contracts issued or renewed on or
3 after that date.

8 The committee substitute provides that the act fulfills an
important state interest and applies to policies and contracts
