  1                      A bill to be entitled

  2         An act relating to consumer rebates; requiring

  3         a person or company that offers a consumer

  4         rebate to provide the rebate to the consumer

  5         within a specified time; requiring that a

  6         consumer be notified by certified mail if

  7         additional information is needed to establish

  8         the merit of the rebate redemption; defining

  9         the term "consumer rebate"; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13  

14         Section 1.  Consumer rebate protection.--

15         (1)  Upon receipt of a request for redemption which

16  meets the terms and conditions of a rebate offer, any person

17  or company that offers a consumer rebate in this state must

18  provide the rebate to the consumer within 15 working days. If

19  additional information is needed to establish the merit of the

20  rebate redemption, the rebate offeror shall serve notice to

21  the consumer by certified mail within 3 working days after

22  receipt of the request for redemption.

23         (2)  As used in this section, the term "consumer

24  rebate" means an offer to provide cash, credit, or credit

25  towards future purchases which is offered to a consumer who

26  acquires or purchases a specified product or service and which

27  is conditioned upon the consumer submitting a request for

28  redemption after satisfying the terms and conditions of the

29  offer. The term does not include any discount from the

30  purchase price which is taken at the time of purchase; any

31  discount, cash, credit, or credit toward a future purchase

 1  which is automatically provided to a consumer without the need

 2  to submit a request for redemption; any refund that may be

 3  given to a consumer in accordance with a company's return,

 4  guarantee, adjustment, or warranty policies; or any reward

 5  program for a company's frequent shoppers or frequent

 6  customers.

 7         Section 2.  This act shall take effect July 1, 2007.
