11  The Committee on Judiciary (Geller) recommended the following
12  amendment:
13  
14         Senate Amendment 
15         On page 2, lines 4-26, delete those lines
16  
17  and insert:  
18         of a personal representative. This paragraph shall not
19  apply to a dwelling unit occupied by a tenant participating in
20  a federally administered or regulated housing program
21  including s. 202, s. 221(d)(3) and (4), s. 236, or s. 8 of the
22  National Housing Act, as amended.
23         Section 2. Subsection (5) of section 83.67, Florida
24  Statutes, is amended to read:
25         83.67 Prohibited practices.--
26         (5) A landlord of any dwelling unit governed by this
27  part shall not remove the outside doors, locks, roof, walls,
28  or windows of the unit except for purposes of maintenance,
29  repair, or replacement; and the landlord shall not remove the
30  tenant's personal property from the dwelling unit unless such
31  action is taken after surrender, abandonment, recovery of

If 3 provided in the rental agreement or a written agreement 4 separate from the rental agreement, upon surrender or 5 abandonment by the tenant, the landlord is not required to 6 comply with s. 715.104 and is not liable or responsible for 7 storage or disposition of the tenant's personal property; if 8 provided in the rental agreement, there must be printed or 9 clearly stamped on such rental agreement a legend in 10 substantially the following form: 11 12 BY SIGNING THIS RENTAL AGREEMENT, THE TENANT AGREES THAT UPON 13 SURRENDER, OR ABANDONMENT, OR RECOVERY OF POSSESSION OF THE 14 DWELLING UNIT DUE TO THE DEATH OF THE TENANT, AS PROVIDED 15 DEFINED BY 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 2 9:14 AM 02/19/07 s0400.ju31.001
