12 following substitute for amendment (082860):

14 Senate Amendment (with title amendment)
15 On page 8, between lines 22 and 23,
16
17 insert:
18 Section 7. Section 553.382, Florida Statutes, is
19 created to read:
20 553.382 Placement of certain housing.--Notwithstanding
21 any other law or ordinance to the contrary, in order to expand
22 the availability of affordable housing in this state, any
23 residental manufactured building that is certified under this
24 chapter by the Department of Community Affairs may be placed
25 on a mobile home lot in a mobile home park, recreational
26 vehicle park, or mobile home condominium, cooperative, or
27 subdivision. Any such housing unit placed on a mobile home lot
28 is a mobile home for purposes of chapter 723 and, therefore,
29 all rights, obligations, and duties under chapter 723 apply,
30 including the specifics of the prospectus. However, a housing
31 unit subject to this section may not be placed on a mobile

1 home lot without the prior written approval of the park owner.
2 Each housing unit subject to this section shall be taxed as a
3 mobile home under s. 320.08(11) and is subject to payments to
4 the Florida Mobile Home Relocation Fund under s. 723.06116.

10 And the title is amended as follows:
11 On page 2, line 14, after the semicolon,
12
13 insert:
14 creating s. 553.382, F.S.; authorizing the
15 placement of residential manufactured buildings
16 that are certified by the Department of
17 Community Affairs on certain mobile home lots;
18 providing for application of state law
19 governing mobile home park lot tenancies to any
20 such housing unit placed on a mobile home lot;
21 requiring the written approval of the owner of
22 a mobile home park before the placement of any
23 such housing unit on a mobile home lot;
24 providing for taxation of such housing units as
25 mobile homes; providing for payments to the
26 Florida Mobile Home Relocation Trust Fund under
27 certain circumstances;
