9 | Be It Enacted by the Legislature of the State of Florida: |
10 |
|
11 | Section 1. Paragraph (c) of subsection (1) of section |
12 | 626.321, Florida Statutes, is amended to read: |
13 | 626.321 Limited licenses.-- |
14 | (1) The department shall issue to a qualified individual, |
15 | or a qualified individual or entity under paragraphs (c), (d), |
16 | (e), and (i), a license as agent authorized to transact a |
17 | limited class of business in any of the following categories: |
18 | (c) Personal accident or travel protection |
19 | insurance.--License covering only policies of personal accident |
20 | or travel protection insurance covering the risks of travel, |
21 | except as provided in subparagraphs subparagraph 2. and 3. The |
22 | license may be issued only: |
23 | 1. To a full-time salaried employee of a common carrier or |
24 | a full-time salaried employee or owner of a transportation |
25 | ticket agency and may authorize the sale of such ticket policies |
26 | only in connection with the sale of transportation tickets, or |
27 | to the full-time salaried employee of such an agent. No such |
28 | policy shall be for a duration of more than 48 hours or for the |
29 | duration of a specified one-way trip or round trip. |
30 | 2. To a full-time salaried employee of a business which |
31 | offers motor vehicles for rent or lease, or to a business entity |
32 | which offers motor vehicles for rent or lease. A business office |
33 | licensed or a person licensed pursuant to this subparagraph may, |
34 | as an agent of an insurer, transact insurance that provides |
35 | coverage for accidental personal injury or death of the lessee |
36 | and any passenger who is riding or driving with the covered |
37 | lessee in the rental motor vehicle if the lease or rental |
38 | agreement is for not more than 30 days, or if the lessee is not |
39 | provided coverage for more than 30 consecutive days per lease |
40 | period; however, if the lease is extended beyond 30 days, the |
41 | coverage may be extended one time only for a period not to |
42 | exceed an additional 30 days. |
43 | 3. To an entity that is: |
44 | a. The developer of a timeshare plan that is the subject |
45 | of an approved public offering statement under chapter 721; |
46 | b. An exchange company operating an exchange program |
47 | approved under chapter 721; |
48 | c. A managing entity operating a timeshare plan approved |
49 | under chapter 721; |
50 | d. A seller of travel as defined in chapter 559; or |
51 | e. A subsidiary or affiliate of any of the entities |
52 | described in sub-subparagraphs a.-d. |

54 | Any entity licensed pursuant to this subparagraph and its |
55 | employees, as the agent of an insurer, may offer policies or |
56 | certificates of insurance that provide coverage for risks of |
57 | travel, including, but not limited to, accidental death and |
58 | dismemberment; trip cancellation, interruption, or delay; loss |
59 | of or damage to personal effects or travel documents; baggage |
60 | delay; emergency medical travel or evacuation; and medical, |
61 | surgical, and hospital expenses of a traveler related to an |
62 | illness or emergency that are incidental to planned travel or |
63 | accommodations. Any such policy or certificate may be issued for |
64 | terms longer than 60 days but each policy or certificate shall |
65 | be limited to coverage for travel or use of accommodations of no |
66 | longer than 60 days. The provisions of this chapter requiring |
67 | submission of fingerprints do not apply to entities licensed |
68 | under this subparagraph. The employee of a licensee who offers |
69 | policies or certificates under this subparagraph must receive |
70 | initial training from a general lines agent or an insurer |
71 | authorized under chapter 624 to transact insurance within this |
72 | state. |
73 | Section 2. This act shall take effect July 1, 2007. |
