A bill to be entitled
2An act relating to voting systems; amending s. 101.5606,
3F.S.; providing an additional requirement for Department
4of State approval of certain voting systems; requiring
5production of a paper record meeting specified criteria;
6requiring preservation of and access to such a record;
7providing for use of such record in a recount of certain
8elections; providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:
11
12     Section 1.  Subsection (16) is added to section 101.5606,
13Florida Statutes, to read:
14     101.5606  Requirements for approval of systems.--No
15electronic or electromechanical voting system shall be approved
16by the Department of State unless it is so constructed that:
17     (16)  It produces a voter-verifiable paper record that is
18suitable for a manual audit and is equivalent or superior to the
19paper record of a paper ballot box system such that the voting
20system, at minimum:
21     (a)  Produces a permanent paper record, each individual
22paper record of which is made available for inspection and
23verification by the voter at the time the vote is cast and
24preserved within the polling place in the manner in which all
25other paper ballots are preserved within the polling place on
26election day for later use in any manual audit.
27     (b)  Provides the voter with an opportunity to correct any
28error made by the system before the permanent record is
29preserved for use in any manual audit. The voter-verified paper
30record produced under this subsection shall be available as an
31official record pursuant to chapter 119 and shall be the
32official record used for any recount conducted with respect to
33any election in which the system is used.
34     Section 2.  This act shall take effect July 1, 2007.
