18 Section 4. Section 320.0609, Florida Statutes, is
19 amended to read:
20 320.0609 Transfer and exchange of registration license
21 plates; transfer fee.--
22 (1)(a) The registration license plate and certificate
23 of registration shall be issued to, and remain in the name of,
24 the owner of the vehicle registered and may be transferred by
25 the owner from the vehicle for which the registration license
26 plate was issued to any vehicle which the owner may acquire
27 within the same classification; or, subject to the procedures
28 set forth in subsection (2), such plate may be surrendered to
29 the department in exchange for a license plate of the
30 appropriate classification, if the replacement vehicle is of a
31 different classification.

1 (b) The transfer of a license plate from a vehicle
2 disposed of to a newly acquired vehicle does not constitute a
3 new registration. The application for transfer shall be
4 accepted without requiring proof of personal injury protection
5 or liability insurance.
6 (2)(a) Upon a sale, trade, transfer, or other
7 disposition of a motor vehicle, the owner shall remove the
8 registration license plate therefrom and either return it or
9 transfer it to a replacement motor vehicle. No registration
10 license plate shall be temporarily or permanently attached to
11 any new or used replacement or substitute vehicle without
12 filing an application for transfer of such registration
13 license plate and paying the transfer fee of $4.50 to the
14 department.
15 (b) The requirement to pay a transfer fee does not
16 apply when the replacement vehicle is classified under s.
17 320.08(2)(b), (c), or (d) or (3)(a), (b), or (c) and the
18 original vehicle to be replaced is also classified under s.
19 320.08(2)(b), (c), or (d) or (3)(a), (b), or (c).
20 (3) A registration license plate assigned to a vehicle
21 is transferable to any other vehicle within the same
22 classification. If the license plate is not transferable, the
23 owner may surrender such license plate to the department in
24 exchange for a license plate of the appropriate classification
25 for use on the newly acquired vehicle.
26 (4) If the replacement vehicle and the original
27 vehicle to be replaced meet the criteria in paragraph (2)(b),
28 there shall be no additional tax required in order to transfer
29 the registration license plate to the replacement vehicle for
30 the duration of a current registration period and to issue a
31 new registration certificate.

1 (5) For a transfer or exchange other than one
2 specified in paragraph (2)(b), the following provisions apply:
3 (a) If the replacement motor vehicle requires the same
4 amount of license tax under s. 320.08 as the original vehicle
5 to be replaced, no additional tax other than the transfer fee
6 of $4.50, accompanied by an application for transfer on a form
7 supplied by the department, is required to transfer or
8 exchange a registration license plate for use on a replacement
9 vehicle for the duration of a current registration period and
10 to issue a new certificate of registration.
11 (b) If the replacement motor vehicle is within a
12 classification requiring a higher license tax than that of the
13 original vehicle to be replaced, the original license plate
14 shall be surrendered in exchange for a plate within the
15 appropriate classification, and an amount representing the pro
16 rata difference in the tax required shall be paid for the
17 remaining months of the registration period. Such payment is
18 in addition to the transfer fee authorized in this section.
19 The minimum charge for issuance of a license plate provided in
20 s. 320.14 does not apply to an exchange of license plates
21 under this section.
22 (6) Upon a sale, trade, transfer, or other disposition
23 of a mobile home, the owner shall remove the sticker therefrom
24 and may exchange it for another sticker to be applied to a
25 replacement mobile home. Such exchange shall be without cost
26 to the owner. No credit will be given toward the purchase of a
27 license plate for any other type of vehicle. The department
28 shall ensure that there is adequate internal control of mobile
29 home stickers that have been removed for exchange or refund.
30 (7) A surviving spouse of a registered owner of any
31 motor vehicle may, upon presenting the death certificate,

1 request a registration certificate and transfer of the
2 registration license plate.
3 (8) Upon transfer or cancellation of a motor vehicle
4 or mobile home, there shall be no refund for any unused
5 portion of a registration period of less than 12 months. If
6 the remaining period of registration is more than 12 months,
7 the registered owner may, upon application, receive a refund
8 of the 12-month fee for registration.
9 (9) The department shall adopt rules governing the
10 processing of applications for and payments of refunds
11 authorized under subsection (8).
