  1                     Senate Joint Resolution

  2         A joint resolution proposing an amendment to

  3         Section 5 of Article XI of the State

  4         Constitution, relating to constitutional

  5         amendments, to require that a statement of the

  6         probable financial impact of any proposed

  7         constitutional amendment or revision be

  8         provided to the public.

  9  

10  Be It Resolved by the Legislature of the State of Florida:

11  

12         That the following amendment to Section 5 of Article XI

13  of the State Constitution is agreed to and shall be submitted

14  to the electors of this state for approval or rejection at the

15  next general election or at an earlier special election

16  specifically authorized by law for that purpose:

17                            ARTICLE XI

18                            AMENDMENTS

19         SECTION 5.  Amendment or revision election.--

20         (a)  A proposed amendment to or revision of this

21  constitution, or any part of it, shall be submitted to the

22  electors at the next general election held more than ninety

23  days after the joint resolution or report of revision

24  commission, constitutional convention, or taxation and budget

25  reform commission proposing it is filed with the custodian of

26  state records, unless, pursuant to law enacted by the

27  affirmative vote of three-fourths of the membership of each

28  house of the legislature and limited to a single amendment or

29  revision, it is submitted at an earlier special election held

30  more than ninety days after such filing.

 1         (b)  A proposed amendment or revision of this

 2  constitution, or any part of it, by initiative shall be

 3  submitted to the electors at the general election provided the

 4  initiative petition is filed with the custodian of state

 5  records no later than February 1 of the year in which the

 6  general election is held.

 7         (c)  The legislature shall provide by general law,

 8  prior to the holding of an election pursuant to this section,

 9  for the provision of a statement to the public regarding the

10  probable financial impact of any proposed amendment to or

11  revision of this constitution proposed by initiative pursuant

12  to section 3.

13         (d)  Once in the tenth week, and once in the sixth week

14  immediately preceding the week in which the election is held,

15  the proposed amendment or revision, with notice of the date of

16  election at which it will be submitted to the electors, shall

17  be published in one newspaper of general circulation in each

18  county in which a newspaper is published.

19         (e)  Unless otherwise specifically provided for

20  elsewhere in this constitution, if the proposed amendment or

21  revision is approved by vote of at least sixty percent of the

22  electors voting on the measure, it shall be effective as an

23  amendment to or revision of the constitution of the state on

24  the first Tuesday after the first Monday in January following

25  the election, or on such other date as may be specified in the

26  amendment or revision.

27                     CONSTITUTIONAL AMENDMENT

28                      ARTICLE XI, SECTION 5

29         FINANCIAL IMPACT STATEMENTS FOR ALL CONSTITUTIONAL

30  AMENDMENTS.--Proposing an amendment to the State Constitution

31  to require that a statement be provided to the public

 2  amendment to or revision of the constitution, rather than

 3  requiring such a statement only for an amendment or revision

 4  proposed by initiative.
