A bill to be entitled
2An act relating to cardiology services; amending s.
3408.0361, F.S.; revising provisions relating to compliance
4with requirements imposed on providers of cardiac
5catheterization services; providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:
8
9     Section 1.  Paragraph (b) of subsection (3) of section
10408.0361, Florida Statutes, is amended to read:
11     408.0361  Cardiology services and burn unit licensure.--
12     (3)  In establishing rules for adult interventional
13cardiology services, the agency shall include provisions that
14allow for:
15     (b)  For a hospital seeking a Level I program,
16demonstration that:,
17     1.  For the most recent 12-month period as reported to the
18agency, it has provided a minimum of 300 adult inpatient and
19outpatient diagnostic cardiac catheterizations or, for the most
20recent 12-month period, has discharged or transferred at least
21300 inpatients with the principal diagnosis of ischemic heart
22disease and that it has a formalized, written transfer agreement
23with a hospital that has a Level II program, including written
24transport protocols to ensure safe and efficient transfer of a
25patient within 60 minutes; or
26     2.  If the hospital seeking a Level I program will be a
27newly licensed hospital established pursuant to a certificate of
28need in a physical location previously licensed and operated as
29a hospital, the former hospital provided a minimum of 300 adult
30inpatient and outpatient diagnostic cardiac catheterizations for
31the most recent 12-month period as reported to the agency and
32the newly licensed hospital has a formalized, written transfer
33agreement with a hospital that has a Level II program, including
34written transport protocols to ensure safe and efficient
35transfer of a patient within 60 minutes. The newly licensed
36hospital must certify that it can provide a minimum of 300 adult
37inpatient and outpatient diagnostic cardiac catheterizations by
38the end of its first year of operation. If the newly licensed
39hospital fails to provide 300 adult inpatient and outpatient
40diagnostic cardiac catheterizations by the end of the first year
41of operation, its license shall be modified to delete Level I
42services. In order to ensure continuity of available services,
43the holder of a certificate of need for a newly licensed
44hospital that meets the requirements of this subparagraph may
45apply for certification of Level I program status before taking
46possession of the physical location of the former hospital. The
47effective date of Level I program status shall be concurrent
48with the effective date of the newly issued hospital license.
49     Section 2.  This act shall take effect July 1, 2007.
