| 7 | responsibility as the owner, registrant, or operator of a |
| 8 | motor vehicle under specified conditions; providing for |
| 9 | eligibility; providing limitations; providing an effective |
| 10 | date. |

| 12 | Be It Enacted by the Legislature of the State of Florida: |
| 13 |
|
| 14 | Section 1. Subsection (8) of section 324.021, Florida |
| 15 | Statutes, is amended to read: |
| 16 | 324.021 Definitions; minimum insurance required.--The |
| 17 | following words and phrases when used in this chapter shall, for |
| 18 | the purpose of this chapter, have the meanings respectively |
| 19 | ascribed to them in this section, except in those instances |
| 20 | where the context clearly indicates a different meaning: |
| 21 | (8) MOTOR VEHICLE LIABILITY POLICY.--Any owner's or |
| 22 | operator's policy of liability insurance furnished as proof of |
| 23 | financial responsibility pursuant to s. 324.031, insuring such |
| 24 | owner or operator against loss from liability for bodily injury, |
| 25 | death, and property damage arising out of the ownership, |
| 26 | maintenance, or use of a motor vehicle in not less than the |
| 27 | limits described in subsection (7) and conforming to the |
| 28 | requirements of s. 324.151, issued by any insurance company |
| 29 | authorized to do business in this state. The owner, registrant, |
| 30 | or operator of a motor vehicle is exempt from providing such |
| 31 | proof of financial responsibility if he or she is a member of |
| 32 | the United States Armed Forces and is called to or on active |
| 33 | duty outside this state or the United States, or if the owner of |
| 34 | the vehicle is the dependent spouse of such active duty member |
| 35 | and is also residing with the active duty member at the place of |
| 36 | posting of such member, and the vehicle is primarily maintained |
| 37 | at such place of posting. The exemption provided by this |
| 38 | subsection applies only as long as the member of the armed |
| 39 | forces is on such active duty outside this state or the United |
| 40 | States and applies only while the vehicle covered by the |
| 41 | security required by this section and s. 324.022 is not operated |
| 42 | by any person within this state and complies with the security |
| 43 | requirements of the state of posting of the active duty member |
| 44 | if such posting is within the United States or any possession or |
| 45 | territory of the United States. |
| 46 | Section 2. This act shall take effect July 1, 2007. |
