24 A bill to be entitled
25 An act relating to drugs; creating s. 831.311,
26 F.S.; prohibiting the sale, manufacture,
27 alteration, delivery, uttering, or possession
28 of counterfeit-resistant prescription blanks
29 for controlled substances with the intent to
30 injure or defraud; providing penalties;
31 amending s. 893.04, F.S.; providing additional

1 requirements for the dispensing of a controlled
2 substance listed in Schedule II, Schedule III,
3 or Schedule IV; specifying circumstances under
4 which a pharmacist who dispenses controlled
5 substances by mail is exempt from certain
6 requirements governing patient identification;
7 providing requirements and limitations for
8 dispensing controlled substances upon an oral
9 prescription; creating s. 408.0611, F.S.;
10 providing legislative intent; providing
11 definitions; requiring the Agency for Health
12 Care Administration to create a clearinghouse
13 of information on electronic prescribing;
14 requiring the agency to monitor and report on
15 the implementation of electronic prescribing;
16 creating s. 893.065, F.S.; requiring the
17 department to develop and adopt by rule the
18 form and content for a counterfeit-proof
19 prescription blank for voluntary use by
20 physicians in prescribing a controlled
21 substance listed in Schedule II, Schedule III,
22 or Schedule IV; providing that penalties shall
23 become effective only upon adoption of rules;
24 prescribing duties of law enforcement agencies
25 and medical examiners when a person dies of an
26 apparent drug overdose; providing an effective
27 date.
