14 On page 12, line 311 through page 13, line 337, delete
15 those lines

17 and insert: the selection or use of such video programming or
18 other programming service.
19 (b) "Cable system" means a facility, consisting of a
20 set of closed transmission paths and associated signal
21 generation, reception, and control equipment that is designed
22 to provide cable service which includes video programming and
23 which is provided to multiple subscribers within a community,
24 but such term does not include:
25 1. A facility that serves only to retransmit the
26 television signals of one or more television broadcast
27 stations;
28 2. A facility that serves only subscribers in one or
29 more multiple-unit dwellings under common ownership, control,
30 or management, unless such facility or facilities use any
31 public right-of-way;

1 3. A facility that serves subscribers without using
2 any public right-of-way.
3 4.3. A facility of a common carrier that is subject,
4 in whole or in part, to the provisions of Title II of the
5 federal Communications Act of 1934, except that such facility
6 shall be considered a cable system other than for purposes of
7 47 U.S.C. Section 541(c) to the extent such facility is used
8 in the transmission of video programming directly to
9 subscribers, unless the extent of such use is solely to
10 provide interactive on-demand services; or
11 5.4. Any facilities of any electric utility used
12 solely for operating its electric utility systems; or.
13 6. An open video system that complies with 47 U.S.C.
14 Section 573.
