11  Senator Bennett moved the following amendment:

13         Senate Amendment 
14         On page 39, line 1090, through page 40, line 1110,
15  delete those lines
16  
17  and insert:  
18         (h)1.  By December 31, 2007 2003, each state agency
19  that provides benefits to persons eligible for Lifeline
20  service shall undertake, in cooperation with the Department of
21  Children and Family Services, the Department of Education, the
22  commission, the Office of Public Counsel, and
23  telecommunications companies providing Lifeline services, the
24  development of procedures to promote Lifeline participation.
25         2.  If any state agency determines that a person is
26  eligible for Lifeline services, the agency shall immediately
27  forward the information to the commission to ensure that the
28  person is automatically enrolled in the program with the
29  appropriate eligible telecommunications carrier. The state
30  agency shall include an option for an eligible customer to
31  choose not to subscribe to the Lifeline service. The Public

 1  Service Commission and the Department of Children and Family
 2  Services shall, no later than December 31, 2007, adopt rules
 3  creating procedures to automatically enroll eligible customers
 4  in Lifeline service.
 5         3.  The commission, the Department of Children and
 6  Family Services, and the Office of Public Counsel shall enter
 7  into a memorandum of understanding establishing the respective
 8  duties of the commission, the department, and the public
 9  counsel with respect to the automatic enrollment procedures no
10  later than December 31, 2007.
