13 Senate Amendment (with title amendment)
14 On lines 1007-1018 delete those lines
15
16 and insert:
17 Section 7. Paragraph (a) of subsection (3) of section
18 350.81, Florida Statutes, is amended, and a new subsection (8)
19 is added that section, to read:
20 350.81 Communications services offered by governmental
21 entities.--
22 (3)(a) A governmental entity that provides a cable or
23 video service shall comply with the Cable Communications
24 Policy Act of 1984, 47 U.S.C. ss. 521 et seq., the regulations
25 issued by the Federal Communications Commission under the
26 Cable Communications Policy Act of 1984, 47 U.S.C. ss. 521 et
27 seq., and all applicable state and federal rules and
28 regulations, including, but not limited to, s. 166.046 and
29 those provisions of chapters 202, 212, and 337, and 610 that
30 which apply to a provider of the services.
31 (8) If within 3 years after the effective date of this

1 act more than 20 percent of the population of a municipality
2 does not have access to two or more competitive
3 facilities-based providers of advanced service and video
4 service, the municipality may provide communications services
5 throughout the municipality after complying with paragraphs
6 (2)(a) and (b) and is not required to comply with the
7 remainder of this section or with s. 166.047(3).

19 s. 364.0361, F.S. conforming a cross-reference;
20 amending s. 364.051,, F.S.; deleting provisions
