13         Senate Amendment (with title amendment) 
14         On page 5, between lines 118 and 119,
15  
16  insert:  
17         Section 2.  The Legislature finds that providing an
18  incumbent cable or video service provider with the option to
19  secure a statutory certificate franchise through the
20  preemption of an existing cable franchise between a cable or
21  video service provider and any political subdivision of the
22  state, including, but not limited to, any municipality or
23  county, is an essential element of the new regulatory
24  framework established by this act as a matter of statewide
25  concern to best ensure equal protection and parity among
26  providers and technologies, as well as to achieve the goals
27  stated by the Legislature in enacting this act.
