  1                      A bill to be entitled

  2         An act relating to complaint review boards for

  3         law enforcement officers and correctional

  4         officers; amending s. 112.532, F.S.; extending

  5         the right to a complaint review board to

  6         sheriffs and deputy sheriffs; providing an

  7         effective date.

  8  

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (2) of section 112.532, Florida

12  Statutes, is amended to read:

13         112.532  Law enforcement officers' and correctional

14  officers' rights.--All law enforcement officers and

15  correctional officers employed by or appointed to a law

16  enforcement agency or a correctional agency shall have the

17  following rights and privileges:

18         (2)  COMPLAINT REVIEW BOARDS.--A complaint review board

19  shall be composed of three members:  One member selected by

20  the chief administrator of the agency or unit; one member

21  selected by the aggrieved officer; and a third member to be

22  selected by the other two members. Agencies or units having

23  more than 100 law enforcement officers or correctional

24  officers shall use utilize a five-member board, with two

25  members being selected by the administrator, two members being

26  selected by the aggrieved officer, and the fifth member being

27  selected by the other four members. The board members shall be

28  law enforcement officers or correctional officers selected

29  from any state, county, or municipal agency within the county.

30  There shall be a board for law enforcement officers and a

31  board for correctional officers whose members shall be from

 1  the same discipline as the aggrieved officer. The provisions

 2  of this subsection shall not apply to sheriffs or deputy

 3  sheriffs.

 4         Section 2.  This act shall take effect October 1, 2007.
