13         Senate Amendment (with title amendment) 
14         On page 14, line 11, through
15            page 15, line 17, delete those lines
16  
17  and insert:  
18         Section 6.  Paragraph (a) of subsection (6) of section
19  394.655, Florida Statutes, is amended, subsection (11) is
20  renumbered as subsection (12), and a new subsection (11) is
21  added to that section, to read:
22         394.655  The Substance Abuse and Mental Health
23  Corporation; powers and duties; composition; evaluation and
24  reporting requirements.--
25         (6)(a)  The corporation shall be comprised of 12
26  members, each appointed to a 2-year term, with not more than
27  three subsequent reappointments, except that initial
28  legislative appointments shall be for 3-year terms. Four
29  members shall be appointed by the Governor, four members shall
30  be appointed by the President of the Senate, and four members
31  shall be appointed by the Speaker of the House of

The four members appointed by the Governor must be 3 prominent community or business leaders, two of whom must have 4 experience and interest in substance abuse and two of whom 5 must have experience and interest in mental health. 6 2. Of the four members appointed by the President of 7 the Senate, one member must represent the perspective of 8 community-based care under chapter 409, one member must be a 9 primary consumer or family member of a primary consumer of 10 mental health services, and two members must be prominent 11 community or business leaders, one of whom must have 12 experience and interest in substance abuse and one of whom 13 must have experience and interest in mental health. 14 3. Of the four members appointed by the Speaker of the 15 House of Representatives, one member must be a primary 16 consumer or family member of a primary consumer of substance 17 abuse services, one member must represent the perspective of 18 the criminal justice system, and two members must be prominent 19 community or business leaders, one of whom must have 20 experience and interest in substance abuse and one of whom 21 must have experience and interest in mental health. The 22 Secretary of Children and Family Services, or his or her 23 designee, the Secretary of Elderly Affairs, or his or her 24 designee, the Secretary of Health Care Administration, or his 25 or her designee, and a representative of local government 26 designated by the Florida Association of Counties shall serve 27 as ex officio members of the corporation. 28 (11)(a) There is established a Criminal Justice, 29 Mental Health, and Substance Abuse Policy Council within the 30 Florida Substance Abuse and Mental Health Corporation. The Secretary of Corrections; 4 4. The Secretary of Health Care Administration; 5 5. The Secretary of Juvenile Justice; 6 6. The Secretary of Elderly Affairs; and 7 7. The State Courts Administrator. 8 (b) The purpose of the council shall be to align 9 policy initiatives in the criminal justice, juvenile justice, 10 and mental health systems to ensure the most effective use of 11 resources and to coordinate the development of legislative 12 proposals and budget requests relating to the shared needs of 13 adults and juveniles who have a mental illness, substance 14 abuse disorder, or co-occurring mental health and substance 15 abuse disorders who are in, or at risk of entering, the 16 criminal justice system. 17 (c) The council shall work in conjunction with 18 counties that have been awarded a Criminal Justice, Mental 19 Health, and Substance Abuse Reinvestment grant to ensure that 20 effective strategies identified by those counties are 21 disseminated statewide and to establish a dialogue for 22 purposes of policy and budget development and system change 23 and improvement. The council shall coordinate its efforts with 24 the Criminal Justice, Mental Health, and Substance Abuse 25 Technical Assistance Center. 26 (d) Each member agency of the council shall designate 27 an agency liaison to assist in the work of the council. 28 Section 7. Florida Senate - 2007 SENATOR AMENDMENT Bill No. CS for CS for SB 542 Barcode 511182 1 (9) "Qualified practitioner" means a psychiatrist 2 licensed under chapter 458 or chapter 459, a psychologist 3 licensed under chapter 490, or a social worker, a mental 4 health counselor, or a marriage and family therapist licensed 5 under chapter 491 who practices in accordance with his or her 6 respective practice act, as determined by rule of the 7 respective boards, has the coursework, training, 8 qualifications, and experience to evaluate and treat sex 9 offenders. 10 Section 8. Subsection (6) of section 948.001, Florida 11 Statutes, is amended to read: 12 948.001 Definitions.--As used in this chapter, the 13 term: 14 (6) "Qualified practitioner" means a psychiatrist 15 licensed under chapter 458 or chapter 459, a psychologist 16 licensed under chapter 490, or a social worker, a mental 17 health counselor, or a marriage and family therapist licensed 18 under chapter 491 who practices in accordance with his or her 19 respective practice act, as determined by rule of the 20 respective boards, has the coursework, training, 21 qualifications, and experience to evaluate and treat sex 22 offenders. 23 Section 9.
