1 A bill to be entitled
2 An act relating to the Florida Highway Patrol
3 Auxiliary; amending s. 321.24, F.S.;
4 incorporating by reference the definition of
5 the term "auxiliary law enforcement officer";
6 authorizing the director of the Florida Highway
7 Patrol to issue certain items to specified
8 retiring auxiliary officers; reenacting s.
9 943.10(8), F.S., which defines the term
10 "auxiliary law enforcement officer"; providing
11 an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Subsection (1) of section 321.24, Florida
16 Statutes, is amended, and subsection (6) is added to that
17 section, to read:
18 321.24 Members of an auxiliary to Florida Highway
19 Patrol.--
20 (1) The director of the Florida Highway Patrol is
21 hereby authorized to establish an auxiliary to the Florida
22 Highway Patrol to be composed of such persons as who may
23 volunteer to serve as members of an auxiliary to the Florida
24 Highway Patrol as defined in s. 943.10(8). Such service to be
25 without compensation to the individual so volunteering.
26 (6) The director of the Florida Highway Patrol may
27 present to an officer who retires from the Florida Highway
28 Patrol Auxiliary after a minimum of 20 years of service one
29 complete uniform, including the badge worn by that officer;
30 the officer's service handgun, if one was issued as part of

1 the officer's equipment; and an identification card clearly
2 marked "RETIRED."
3 Section 2. Subsection (8) of section 943.10, Florida
4 Statutes, reads:
5 943.10 Definitions; ss. 943.085-943.255.--The
6 following words and phrases as used in ss. 943.085-943.255 are
7 defined as follows:
8 (8) "Auxiliary law enforcement officer" means any
9 person employed or appointed, with or without compensation,
10 who aids or assists a full-time or part-time law enforcement
11 officer and who, while under the direct supervision of a
12 full-time or part-time law enforcement officer, has the
13 authority to arrest and perform law enforcement functions.
14 Section 3. This act shall take effect July 1, 2007.

17 SENATE SUMMARY
18 Authorizes the director of the Florida Highway Patrol to
present a uniform, service handgun, and identification
19 card to a member of the Florida Highway Patrol Auxiliary
who retires after at least 20 years' service.
