A bill to be entitled
2An act relating to the human papillomavirus; requiring
3public and private middle schools in the state to provide
4to certain students and their parents or guardians
5information concerning the human papillomavirus, its
6vaccine, and cervical cancer; prohibiting certain students
7from admission into school without providing evidence of
8vaccination for the human papillomavirus; providing an
9exception; prohibiting a principal from knowingly
10admitting a student into school without evidence of
11vaccination for the human papillomavirus; providing an
12exception; requiring the Department of Education, in
13consultation with the Department of Health, to prescribe
14the content of the information regarding the connection
15between the human papillomavirus and cervical cancer and
16the availability of a vaccine preventing human
17papillomavirus; providing an effective date.

19Be It Enacted by the Legislature of the State of Florida:

21     Section 1.  (1)  Beginning with the 2008-2009 school year,
22each public or private middle school in this state shall provide
23to each student who is 11 years of age or 12 years of age and to
24the parents or guardian of such student information concerning
25the connection between the human papillomavirus (HPV) and
26cervical cancer and the availability of a vaccine preventing
27human papillomavirus.
28     (2)  Beginning with the 2008-2009 school year:
29     (a)  A student who is 11 years of age or 12 years of age
30may not be admitted to any private or public school in this
31state until that student submits to the school acceptable
32evidence of vaccination for the human papillomavirus or proof
33that, after receiving the information required in subsection
34(1), the student's parent or guardian has elected that the
35student not receive the vaccine.
36     (b)  A principal or any other person in charge of a public
37or private school may not knowingly admit a student who is 11
38years of age or 12 years of age until that student submits to
39the school acceptable evidence of vaccination for the human
40papillomavirus or proof that, after receiving the information
41required in subsection (1), the student's parent or guardian has
42elected that the student not receive the vaccine.
43     (3)  The Department of Education, in consultation with the
44Department of Health, shall prescribe the content of the
45information required in subsection (1).
46     Section 2.  This act shall take effect July 1, 2008.
