11 The Committee on Community Affairs (Geller) recommended the
12 following amendment:

14 Senate Amendment (with directory and title amendments)
15 On page 1, lines 19-22, delete those lines
16
17 and insert: than 50 percent of the land in such area consent
18 to such annexation. Such consent shall be obtained by the
19 parties proposing the annexation prior to the referendum to be
20 held on the annexation. In a county that has a population
21 greater than 500,000, that contains more than 20
22 municipalities, and that contains at least one municipality
23 having a population greater than 250,000, state-owned lands
24 may not be included for purposes of determining whether:
25 (a) More than 70 percent of the property to be annexed
26 is not owned by registered electors; and
27 (b) The owners of more than 50 percent of the land in
28 the area proposed to be annexed consent to annexation.
29 (6) Notwithstanding subsections (1) and (2), if the
30 area proposed to be annexed does not have any registered
31 electors on the date the ordinance is finally adopted, a vote

1 of electors of the area proposed to be annexed is not
2 required. In addition to the requirements of subsection (5),
3 the area may not be annexed unless the owners of more than 50
4 percent of the parcels of land in the area proposed to be
5 annexed consent to the annexation. If the governing body does
6 not choose to hold a referendum of the annexing municipality
7 pursuant to subsection (2), then the property owner consents
8 required pursuant to subsection (5) shall be obtained by the
9 parties proposing the annexation prior to the final adoption
10 of the ordinance, and the annexation ordinance shall be
11 effective upon becoming a law or as otherwise provided in the
12 ordinance. The consent requirements in this subsection do not
13 include consent with respect to state-owned land in a county
14 that has a population greater than 500,000, that contains more
15 than 20 municipalities, and that contains at least one
16 municipality having a population greater than 250,000.
